Board of Central Contra Costa Sanitary District convened in a Regular Session at its regular place of meeting located at 1822 Mt. Diablo Boulevard6 City of Walnut Creek6 County of Contra Costa, State of California, on May 5,1955, at 8:00 o'clock P.M. , "'----' The meeting was called to order by President Roemer. I. ROLL CALL PRESENT: ABSENT: Members: Mitchell, Fisher, Salfingere aná Roemer S,pieg 1 Member: II., APPROVAL OF MINUTES The Minutes of ,the meeting of Apr~l 216 1955, were approved as presented. III. APPROVAL OF BILLS It was moved by Member Salfingere, second~d by Member Mitchell, that the bills as audited by the Auditing Committee and as submitted by the District Manager be approved, reference being specifically made to Sewer Construction Vouchers Numbers l.JJ6 to 454, inclusive, and Running Expense Vouchers Numbers 9823 to 994h, inclusive. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Member: Mitchell, Fisher6 Salfingere and Roemer None Spiegl ~-, Member Spiegl arrived at 8:08 P.M. OPENING OF BIDS, TRUNK SE1JITER SECTION 14 President Roemer called for the opening of bids on Trunk Sewer Section 14. The bids were as follows: John H. 'McCosker, Inc. Engineerg Limited Pipeline Company McGuire & Hester $ 84,059.00 98,112.05 131,131.50 It was moved by Member Fisher, seconded by Member Mitchel16 that the contract for Trunk Sewer Section 14 be awarded to John H. McCosker, Inc. on their low bid of $84,059.00. Carried by the following vote: AYES: Members: Mitchell, Fisher, Spiegl, Salfingere and Roemer NOES: Members: None ABSENT: Members: None IV. HEARINGS LOCAL IMPROVEMENT DISTRICT NO. 3Ö6RESOLUTION OF INTENTION NO. 887 President Roemer opened the hearing on Resolution of Intention No. 887 and adjourned to the Legion Hall in Walnut Creek in order to accommodate the large audience. --.... - 05 05 55 '\ 91 President Roemer sQ~arized the problem in the area and stated that the Health Department had requested assistance in finding a solution to correct the inadequate systems in the area. He stated the installation of a small line to take care of the worst proble~ would be uneconomic, therefore, the larger line was decided upon to correct the overall problem. President Roemer stated that the usual land area basis of assessment would create a hardship, and the foresight of the District personnel had enabled assessments on a residence basis. ,--, Mr. Roscoe Jones, Jr., representing twelve property owners on the west boundary line of the proposed area, asked to'be excluded. He stated that the properties were hill land and would receive no direct benefit. He also stated they did not contribute to the health problem. Mr. Gordon Turner, 'representing Mr. George Jovick# the developer of Mo~tair, presented a map of Montair showing the twenty-nine protests filed from the area, three of which did not protest, and a certified copy of the restrictions. Mr. Turner asked for exclusion of the area on the basis of no benefit and stated that they had no sewage problem nor did they believe their area would develop into a health problem. Mr. C. R. Graf protested the inclusion of Montair. Mr. William O'Connell, Consultant to the Planning Commission, and Mr. Thomas McMorrow of the Health Department made statements and were questioned by members of the audience. ,-----.., Others heard in protest were: Mr. Sandkuhle, Mr. W. D. Barton, representing San Ramon Heights Association, Mr. Donald Graves, Mrs. Winston Petty, Mr. Winston Petty, Mr. Claude Artero, Mr. Jac~ West, Mr. Orville Rakestraw, Mr. Carl Geiser, Mr. William Coffee, Mr. John di Donato, Dr. Darby, and Mr. Russell Schumacher. President Roemer stated that the written protests received and the protests heard at the meeting would be reviewed and considered by the Members of the Board. The Hearing on Resolution of Intention No. 887 to be continued to Hay 9, 1955. v. OLD BUSINESS None. VI. REPORTS DISTRICT MANAGER Mr. Horstkotte, District Manager, read a letter from the Employees' Association thanking the District Board for the action taken in amending the vacation and sick leave allowed. COUNSEL FOR THE DISTRICT Mr. Nejedly requested to have easement line changed in Wheeler Ranch Condemnations. RESOLUTION NO. 891, A~ffiNDING RESOLUTION NO. 880 AUTHORIZING CONDEMNATION OF BOURGOIN, SOULE, LE DUC AND EWEEL EASEMENTS It was mòved by Member Fisher, seconded by Member Salfingere, that Resolution No. 891 be adopted. VII. NEW BUSINESS RESOLUTION NO. 890, APPROVING ASSESSME1~ DIAGRAM, LOCAL IMPROVEMENT DISTRICT NO. . 31 It was moved by Member Spiegl, seconded by Member Salfingere, that Resolution No. 890 be adopted. Carried by the following vote: AYES: Members: NOES: ABSENT: Members: Members: ~ Mitchell, Fisher, Spiegl, Selfingere and Roemer None None Resolution No. 890 on file in the office of the Secretary is hereby referred to and by reference made a part hereof. REQUEST FOR ANNEXATION, WILD "rINGS MANOR SUBDIVISION AREA It was moved by Member Salfingere, seconded by Member Mitchell, that the terms for the annexation of Wild Wings Manor Subdivision Area be $191.00 per acre plus $350.00 cost for processing. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Members: Mitchell, Fisher, Spiegl, Salfingere and Roemer None None ACCEPTANCE OF EASEMENT, ALLAN FULLER AND JACK R. EYMAN It was moved by Member Mitchell, seconded by Member Fisher, that the easement from Allan Fuller and Jack R. Eyman be accepted and i tã recording ordered.
