Diablo Boulevard, City of Wal nut Creek, County of Contra Costa, State of california. on April 7,1955. at 8:00 o'clock P.M. , ' '- The meeting was called to order by President Roemer. I. AMENDfNG REnULATIONS qoVERNING EMPLOYEæ' SICK LEAVE AND VACATI N It was moved by Member Salfingere, seconded by Member FiSher, that Resolution No. 879 be adopted. LOCAL IMPROVEMENT DISTRICT NO. 30 - Mr. Horstkotte, District Manager, reported to the District Board that the Board of Supervisors had the previous day consented to the formation of the proposed Local Improvement District outside of the Sanitary District boundaries an~ that the Board of Supervisors had expressed complete and sincere faith in the Sanitary District Board. ......... - 04 07 55 81 Mr. Horstkotte commended Mr. Nejedly, Counsel for the District, and Member Spiegl, together with the following employees for their efforts in getting the proceedings off to a successful start: Mr. Jack Best, Mr. Clyde Hopkins, Mr. Jess Paf>z, Mr. Theron Martin, and the Survey Crew. Mr. Sturgis, counsel retained to review ~cal,Improvement District No. )0 proceedings along with Mr. Nejedly, was introduced to the District Board. ,-.." , ! . - Mr. Nejedly presented and explained the various resolutions relative to Local Improvement District No. 30; Mr. Sturgis indicated these were in order. Mr. Sturgis stated that neither he or Mr. Nejedly cou1d guarantee that the proceedings would not be attacked and, it attacked, how long litigation might last, that the proceedings to date were in order and in the opinion of Mr. Sturgis, were valid. COUNTY HEAt.TH OFFICER: "Gentlemen: A recent investigation of conditions existing in the area hereinafter described in the Coun~ ot Contra Costa, discloses such, conditions to be unsdtary, unhealth1"ul, . and 111 ., opinion,. dangerous to the health ot the people living therein. Said area is bounded and described as tollows: -'1 That certain area referred to as "Boundary Description ot Local Improvement District No. 30", which description is attached hereto and by reference made a part hereof. As Health Otficer of the County of, Contra Costa, I recommend as a necessary health measure that your honorable Board institute proceedings pursuant to the Improvement Act of 1911 and as proposed by your Board at, an earJ.7 date tor the construction ot a sani tar,. sewer S'1stem for said area to abate the unsanitary conditions therein. FINDING NECESSITY IT IS HEREBY REOOLVED b7 the District Board of the Central Contra Costa Sanit&r7 District that the necessity, as a health measure, tor sewers in that area and for those proceedings describ- ed in the letter of Dr. H. L. Blum, Health Officer of Contra Costa County, addressed to this Board and dated 7th day ot April, 1955, is by this Board similarly tound to exist. Said letter is hereby referred to and made a part hereof-, and ordered spread upon the Minutes of this Body. IT IS FURTHER RESOLVED that such sewers the installation thereof and assessment proceedings therefor are found and declared to be necessar'1' as a health measure. Mr. Nejedly. stated that thi8 matter: was di8cussed with the Board of Supervisors and it was dete~ed that the District. Attorney,.Ør. O'Connell and Mr. SàUor would assist the Sanitary District. . PUBLIC INFORMATION PROGRAM Member Mitchell submitted a letter to be sent to a select. groupòf individuals and organizations within the Sanitary District together with a questionnaire to be tilled out. and returned ~~ a selt-addressed, stamped envelope, as follows: LETTER "pear Sir (s ),: n~e'Board ot Directors of t~o Central Contra Costa Sani~817 District has for ~ome time recognL$ed the desirability of keeping residents and taxpayers informed ot actions and problems of the District. Citizens interested in the District have encouraged the the Board to establish a broad public information program for this purpose. . . ~ "The Board plans to inform the public through regular news- paper releases and public appearances of members of the Board and District before civic organizations. These methods, of course, reaeb only a part ot the public and provide only limited news of the District. - 04 07 55 93 ~-~ "Another medium of' news reiease or report to the public has been suggested. This involves mailing of a monthly or bimonthly report to all civic organizations and citizens interested in receiving suCh a report. Distribution could vary between 2000 to 5000 copies. It is not intended to extend distribution to all persons of the District except on request or inaication of interest. Since a mailed report couJ.d amount to a sizeable expendi ture for part-time services of a publicist, printing, and mailing,tq.e Board has been reluctant to proceed with such a program until the attitude of the public is thoroughly investigated. "The Board of' Directors, theref'ore. has selected a repre- sentative group of citizens and organizations to obtain opinion and attitude toward such a program. District Manager, reported that the cards returned from the property owners in the area showed that a majority were. in favor of sewers. Member Spiegl suggested that a follow-up letter be sent to residents of' the area stating that since a majority have f'avored sewers, along with the action recommended by the Health Department, Local Improvement Dlstriat prøceed1ns8 will start after a certain date. ~:"~' ¡ 04 07 55 ., 84 Secretary was instructed to prepare a letter, as ~ggested, for approval at the next meeting prior to mai~ing. VI. RE~ORTS. DISTRICT MANAGER None. COUNSEL FO R THE DISTRI CT .......... Mr. Nejedly.requested that the Board ëondemn three easements necessary to sewer the Wheeler Ranch. Mr. Horstkotte, District Manager, reported that the easements were necess8.17. Member Spiegl objected to the District's filing and becoming a part ot the condemnation and felt that the interested parties should take over. Mr. Nejedly, Counsel for the District, stated that it was necessary that the District tile the proceedings, but the ti~e ot District personnel would be eliminated. TRUNK SEWER 14 It was moved by Member Spiegl, seconded by Member Fisher, that the Wage Scale for Trunk Sewer 14, as presented, be adopted and the Secretary be authorized to call for bids. Carried by the following vote: AYES: NOES: ABSENT: Members: Mitchell, Fisher, Spiegl, Salfingere and Roemer None None Members: Members: MATTERS FROM THE FLOOR VISTA GRANDE SUBDIVISION SEWERS . -, . Mr. Webster, representing the Vista Grande Subdivision in Danville, asked about sewering the Subdivision. Mr. Horstkotte. District Manager, explained the various ways it could be accomplished. If the property owners want a Local Improvement District this year, it would have to be done by out- side engineering, reviewed and approved by the. Sanitary District, the Dis~rict presently having all it can handle for this year. Mr. Nejedly, Counsel for the District, agreed that it could be handled in this. manner. ~OW~DCäD~LR~O~ - - Mr. John Norgaard, of Brown and Caldwell, reported to the District Boaréi on work that had been accomplished to date on their contract with the District. VIII. ADJOURNMENT At 10:08 o'clock P.M., the me~ting was adjourned by President Roemer to April 21,1955.
