HomeMy WebLinkAboutBOARD MINUTES 09-04-91 162 MINUTES OF THE ADJOURNED REGULAR BOARD MEETING , OF THE DISTRICT BOARD OF THE CENTRAL CONTRA COST ASANIT ARY DISTRICT HELD ON SEPTEMBER 4, 1991 The District Board of the Central Contra Costa Sanitary District convened in an Adjourned Regular Session as its regular place of meeting, 5019 Imhoff Place, Martinez, County of Contra Costa, State of California, at 7:30 p.m. on September 4,1991. President Clausen called the meeting to order and requested that the Secretary call roll. 1. ROLL CALL PRESENT: ABSENT: Members: Members: Boneysteele, Dalton, Rainey, Clausen None 2. PUBLIC COMMENTS None 3. HEARINGS a. CONDUCT PUBLIC HEARING AND CONSIDER CERTIFICATION OF THE FINAL EIR FOR THE PLEASANT HILL SEWER OVERFLOW PROTECTION PROJECT, DP 4717 Mr. Roger J. Dolan, General Manager-Chief Engineer, was unavoidably detair.ed. In his absence, Mr. Robert A. Baker, Deputy Chief Engineer, stated that this public, hearing is the culmination of several meetings over the last few months to acquaint the public with the Pleasant Hill Sewer Overflow Protection Project. Many of the questions and concerns of the public have been addressed as a result of the workshops that have taken place to date. Mr. Baker introduced Mr. Tad Pilecki, Senior Engineer, who stated that at the August 15, 1991, Board Meeting, a fairly detailed overview of the project was presented. This public hearing is the 21 st presentation on the project. Mr. Dolan entered the meeting at the hour of 7:38 p.m. Mr. Pilecki stated that the Pleasant Hill Sewer Overflow Protection Project will address sewer overflows experienced by the District during wet weather events. Mr. Pilecki reviewed the project approach and highlighted the recommended alternatives. Mr. Pilecki presented the staff recommendations. that Routes 8, 9, 10, 11, 16, and 19B be dropped from furtheJ consideration; that Routes 1, 3, 12, 16A, 19, and 20 be approved; and that staff be authorized to further evaluate Parallel Segments 14 versus 13 and 15, and 17 versus 18. Mr. Pilecki summarized the basis for the staff recommendations as set forth in the handouts presented to the Board. Mr. Russ Leavitt, Planning Assistant, reviewed the scope of the Environmental Impact Report (EIR), the environmental issues analyzed, the potential short-term and long-term impacts of the project, mitigation measures, key issues raised in the draft EIR, and the mitigation monitoring and reporting program. Discussion followed concerning the Bay Area Air Quality Management District regulation dealing with hydrocarbon emissions caused by the use of asphalt in paving materials, the use of the phrase "irrevocable environmental change" for such minor disturbances as a change in the bus schedule or route, providing adequate off-street parking for construction workers' vehicles, the impacts on the Toys "R" Us operation, and the need to ensure that only reasonable conditions are required by the cities in encroachment permits. ¡ '; 09 j O(~' 91 163 At 8: 15 p.m., President Clausen opened the public hearing to receive' comments regarding the certification of the Final EIR and approval of the proposed Pleasant Hill Sewer Overflow Protection Project. Ms. Helen Albrick, Property Manager for Jarvis & Associates, addressed the Board on behalf of the owners and merchants of the Pleasant Hill Shopping Center. Ms. Albrick distributed copies of a letter from Jarvis & Associates and summarized its contents for the Board, stating that the need for the project is recognized. However, there is concern about the disruption to traffic and the effect on sales. In addition, the owners of the Pleasant Hill Shopping Center are concerned about their future ability to develop the land and the future marketability of the property. Ms. Albrick discussed the potential impacts of the various alternative alignments on business in the Pleasant Hill Shopping Center. In closing Ms. Albrick requested that Jarvis & Associates and the merchants of the Pleasant Hill Shopping Center continue to be included in the decision making process with regard to the project, and that the final selection of segments include strong mitigation measures which will be enforced. Discussion following concerning future development of the shopping center, the estimated period of disruption, and possible alternative trenching techniques that may lessen the impact on businesses in the area. There being no further questions or comments, President Clausen closed the public hearing at the hour of 8:36 p.m. It was moved by Member Dalton and seconded by Member Rainey, that Resolution No. 91-081 be adopted, certifying the Final Environmental Impact Report for the Pleasant Hill Sewer Overflow Protection Project, DP 4717, as legally adequate. Motion unanimously approved on the following roll call vote: AYES: , NOES: ABSENT: Members: Members: Members: Dalton, Rainey, Boneysteele, Clausen None None It was moved by Member Rainey and seconded by Member Dalton, that the Pleasant Hill Sewer Overflow Protection Project be approved, and that Resolution No. 91-082 be adopted to that effect. Motion unanimously approved on the following roll call vote: AYES: NOES: ABSENT: Members: Members: Members: Rainey, Dalton, Boneysteele, Clausen None None It was moved by Member Dalton and seconded by Member Rainey, that the Conditions of Approval, Findings of Fact, Statement of Overriding Considerations, and the Mitigation Monitoring and Reporting Program for the Pleasant Hill Sewer Overflow Protection Project be adopted. Motion ,unanimously approved on the following roll call vote: AYES: NOES: ABSENT: Members: Members: Members: Dalton, Rainey, Boneysteele, Clausen None None Member Boneysteele was joined by Mr. Dolan in commending staff for the thoroughness of the public outreach program on the Pleasant Hill Sewer Overflow Protection Project. 4.
