HomeMy WebLinkAboutBOARD MINUTES 05-20-65 82 MINUTES OF AN ADJOURNED REGULAR MEETING OF T~ DISTRICT BOARD CENTRAL CONTRA COSTA SANITARY DISTRICT HELD MAY 20, 1965 The District Board of Central Contra Costa Sanitary District convened in an Adjourned Regular Session at its regular place of meeting located at 1250 Springbrook Road, Walnut Creek, County of Contra Costa, State of California, on May 20,1965, at 8:00 o'clock P.M. The meeting was called to order by President Mitchell. 1. ROLL CALL PRESENT: Members: Gibbs, Rustigian, Howard and Mitchell ABSENT: Member: Roemer II. APPROVAL OF MINUTES At the request of }fr. Ernest Wilson, Attorney for Local Improvement District No. 44, 1.t was moved by Member Gibbs, seconded by Member Rustigian, that the Minutes of the meeting of May 6,1965, be approved, subject to rescinding the Motio~ amending the Minutes of the meeting of April 15,1965, and spreading the Health Officer's letter as it was originally spread in those Minutes. HEARINGS President Mitchell opened the Hearing for Local Improvement District No. 4L. and stated that there were eight sections indicated as Schedules 1 thru 8, and protests would be heard separately for each Schedule. Mr. Horstkotte, Engineer for Local Improvement District No. It/J, re- ported there were no written protests. President Mitchell asked for oral protests. President Mitchell asked for oral protests. Mr. F. E. Kuhn of 21 Bolla Avemle, Alamo, stated he did not receive a notice. Upon indicating the location of his property on the map, he was informed he was not in the Assessment District. }fro Pizzagoni and }fro Taylor had questions answered. There being no oral or written protests, President Mitchell closed the Hearing for Local Improvement District No. hIL-h. Do~ah~e, protesting inclusion in the Assessment District. President Mitchell informed ì1r. Donahue that his protest for exclusion had been denied at a previous meeting. Assessment Parcel No. 44-5-u-18, Polly Jean Gouchie Walton and Robert E. Walton, protesting the amount of their assessment and inclusion in the Assessment District. Væ. Horstkotte, Engineer for Local Improvement District No. !IU, stated that ì1r. and Mrs. Walton had one unit of assessment and had sighed a petition to be included in the Assessment District. Assessment Parcel No. L.iL-5-il-l thru 5, H. Corey, D. D. Kingman, A. F. Lawton, R. W. Cross and C. A. Johnson. Letter was received from A. F. Lawton on behalf of the above property o~ners protesting more that one unit of assessment. President Mitchell asked the Board Members whether any wished to re- consider their conclusions determined in discussions Rt a prior Board Hearing. Members response was negative. They also asked assurance that these assessments would be the ultimate cost regardless of hoil the property was divideà in the future. They were informed that this was the policy of the present District Board, but future Boards could not be committed to any such agreement. 05 20 "'5 \) 8'1 Assessment Parcel No. ~~-5-3-12, Emile Dore'. Mr. Dore's letter stated there would he no protest if the line to serve his property is extended l3 feet, as agreed to with the District. Hr. Horstkotte, Engineer for Local Improvement District lb. lilt, stated that the line serving the Dore' property is to be extended 13 feet. There being no further written protests, President Mitchell asked for oral protests. There being none, President Mitchell closed the Hearing for Local Improvement District No. 44-5. It was moved by Member Gibbs, seconded by Member Rustigian, that the protests for Local Improvement District No. 44-5 be denied. Hitchell asked for written protests for Local Improvement District No. L.L., Schedule 6. .!VIr. Farmer, protesting the amount of their assessment, their inclusion in the Assessment District and stating that their septic tank is in good condition. Hr. Horstkotte stated the Farner property had received one unit of assessment. Assessment Parcel No. 44-6-10-22, Roscoe Jone!=', Jr." Attorney on 'behalf of George Latimer, protesting m.iml::er of assessment units. Y.r. Horstkotte, Engineer for Local Improvement District No. 44, stated that the Deed restrictions call for not less that one-acre sites. The assessment was for 3 building sites on 3.9 acres. There being no further wTi tten protests, President !v1i tche 11 asked for oral protests. Assessment Parcel No. 44-6-5-24, William Watson. Mr. Watson stated that his property has been in the District for several years and he has been paying taxes, and objected to having been taken into the District at that time. Mr. Horstkotte, Engineer for Local Improvement District No. Il~L, stated that Mr. Watson had signed a petition to annex to the District at that time, and that those properties in the District, at that time, had received a lower assessment than those not previously in the District, due to the present higher annexation fee. There being no further protests, President Mitchell closed the Hearing for Local ~~rovement District No. 4u-6. It was moved by Hember Gibbs, seconded by ì1ember Ho1rrard, that the pro- tests for Local Improvement District No. ~i¡-6 be denied. Jov'ick. Hr, 1. Leiber questioned whether Parcel No. hu-7-12-10 was a building si te . Mr. Horstkotte, Engineer for Local Improvement District No. hlL, pre- sented a copy of the letter from the County Planning Commission stating it is a building site and a building permit would be cleared. Mr. Horstkotte stated the property was given one unit of assessment. There being no further written protests, President Mitchell asked for oral protests. There being none, Prisident Mitchell closed the Hearing for Local Improvement District No. 44-7. It was moved by Member Howard, seconded by Nember Rustigian, that the protests for Local Improvement District No. 4L.-7 be denied. Morken, Attorney for ~~. Cornelison, presented a letter pro- testing inclusion in the Assessment District, stating that service to the property had been provided for. The Members of the District Board discussed with Hr. CorY1pJ.i son the inclusion of his property iT: the Assessment District and his previous assessment in Local Improvement District No.8. After discussing the higher-than-estimated bid for the work, the ~istrict Board directed that the property' owners in Local Improvement District No. !¡IL-8 be notified of a continued Hearing to discuss with the Board Members whether the contract for the work shall be awarded at this time. v. Horstkotte, District Manager-Engineer, stated there are three trees along the line of the easement of Parcel hu-6-9 and every effort 'lrJill be made to save the trees. But if they die vrlthin one year, as a result of the work, it is the staff recommendation to give Mr. and I1rs. Bailie a letter stating they will be compensated $110.00 for a 5" Peach tree, $125.00 for a 6" Plum tree and $270.00 for ::n 8" Purple Leaf Flowering Plum tree. TAGG Mr. Horstkotte, District Manager-Engineer, reported that rTr. C. Terence Ring, Attorney, filed a claim for damages on behalf of George Ii. Tagg in the amount of $7,500.00, as a result of sewer overflow in his home. This sum fueing over the $500.00 deductible amount, the claim should be referred to the District's insurance carrier. It was moved by Hemœr Gibbs, seconded by Member Rustigian, that the claim of George II. Tagg for damages be referred to the District's insur- ance carrier. REPORTS DISTRICT MANAGER-ENGINEER TOUR OF DISTRICT TREAT'dENT PLANT Mr. Horstkotte, District Manager-Engineer, gave each Board Member an Agenda for the San Francisco Bay Area Hater Pollution Control Federation visit and tour of District facilities on June 3,1965. Members of the District Board decided that the June 3,1965, RegDlar Meeting shall be held Wednesday, June 2,1965, so the Board Members may participate in the San Francisco Bay Area Water Pollution Control Federation visi t and tour of District facilities. LINE E PRCGRESS Mr. Horstkotte reported on the progress of Line E. AUTHORIZATION FOR PERMANENT RECORDS FlIES Hr. Horstkotte requested aèlthorization to -pay the $!,uS.OO for the permanent records files work at the Treatment Plant which is now completed. It was moved by Member Gibbs, seconded by Member Rustigian, that $4w8.00 be paid from Sewer Construction Funds to Ivar K. Fjellbo, the ::or.tractor who installed the permanent record files at the Treatmert Plant.
