MINUTES OF AN ADJOURNED REGULAR MEETING
OF THE DISTRICT BOARD
CENTRAL CONTRA COSTA SANITARY DISTRICT
HELD NOVEMBER 11, 1963
The District Board of Central Contra Costa Sanitary District convened
in an Adjourned Regular Session at its regular place of meeting located at
1250 Springbrook Road, Walnut Creek, County of Contra Costa, State of
California, on November 11,1963, at 8:00 o'clock P.M.
President Mitchell called the Regular Adjourned Session to order to
further discuss the M. Miller Company litigation.

Gibbs, Roemer, Fisher, Bowman and Mitchell

II.
M. MILLER CDMPANY LITIGATION
Mr. Bolm, Counsel :for the District, expressed his views that it would
be advisable to try to work out a settlement of the M. Miller Company
litigation, based upon conferences with defense trial counsel and informal
discussions with the Court.
He stated that he felt it could be settled upon the basis of the
District releasing the money earned by M. Miller Company, but withheld
by the District, and an additional amount as a compromise figure which
would be less than the interest which would have been due on the amount
wi thheld :from M. Miller Company.
Mr. Bolm presented various figures and discussed the reasons for the
settlement.
After discussion, it was moved by Member Roemer, seconded by Member
Bowman, that Mr. Bolm be authorized to settle the M. Miller Company
litigation for an amount up to $155,000.00 from Sewer Construction Funds.
Carried by the following vote:
AYES: Members: Gibbs, Roemer, Fisher, Bowman and Mitchell
NOES: Members: None
ABSENT: Members: None
IV. ADJOURNMENT
At 9: 20 0 I clock P.M., the meeting was adj ourned by President Mitchell
to November 21,1963.
