I MINUTES OF A REGULAR MEETING OF THE DISTRICT BOARD CENTRAL CONTRA COSTA SANITARY DISTRICT HElD FEBRUARY 7, 1963 The District Board of Central Contra Costa Sanitary District convened in a Regular Session at its regular place of meeting located at 1250 Spring- brook Road, Walnut Creek, County of Contra Costa, State of California, on February 7,1963, at 8:00 o'clock P.M. The meeting was called to order by President Mitchell. I. ROLL CALL PRESENT: Members: Gibbs, Roemer, Fisher and Mitchell ABSENT: Member: Bowman II. APPROVAL OF MINUTES The Minutes of the meeting of January 17,1963, were approved as presented. III. APPROVAL OF EXPENDITURES It was moved by Member Roemer, seconded by Member Gibbs, that the expendi- tures, as audited by the Auditing Committee and as submitted by the District Manager-Engineer, be approved, reference being specifically made to Sewer Construction Vouchers Numbers 1535 to 1551, inclusive, and Running Expense Vouchers Numbers 1025 to 1208, inclusive. Hr. Horstkotte, District Manaper-Engineer, explained that bids had been received on one additional vehicle than was provided for in the Budget due to the vehicle's poor condition. The bid of Parker-Robb Chevrolet was $258.23 over the Budget for the additional vehicle, and he recommended that the bid of Parker-Robb Chevrolet be accepted for all the vehicles. It was moved by Member Fisher, seconded by Menilier Gibbs, that Parker-Robb Chevrolet's bid be accepted for the seven new vehicles, less trades, in the sum of $11,148.23, which includes one vehicle over that allowed in the Budget at an added cost of $258.23. OLD BUSINESS QUIT CLAIN DEED FROH THE COUNTY OF CONTRA COSTA FOR LAS LŒ-1ITAS SETdER JV.lAIN'I'ENANCE DISTRICT PROPERTIES Mr. Horstkotte, District Manager-Engineer, reported that the staff had checked the records and found there is no real property involved, only existing sewer lines which the District took over at the time Las Lomitas annexed to the District. It was moved by Member Fisher, seconded by Member Gibbs, that the Quit Claim Deed from Contra Costa County for Las Lomitas Sewer Haintenance District properties be accepted and its recording ordered. NEW BUS INF.15S TRUNK SEHER D, SECTIONS 2 THRU 10, PARCEL 11, SETTLEI'1ENT }1r. Horstkotte, District Manager-Engineer, reported that the lVlinutes of December 13, 1962, referred to settlement of "Trunk Sewer G, Sections 11 Thru 17, easement Parcel 11" Hhereas the reference should have been to Trunk SevJer D, Sections 2 Thru 10, easement Parcel 11, and requested a ne" rr.otion to effect the correction. It was moved by Member Roemer, seconded by Hember Fisher, that the District staff be authorized to offer $350.00 in settlement for Parcel 11, Trunk Se~~r D, Sections 2 Thru 10, with the property owner reserving the right to build over the easement area. NEJEDLY, DISTRICT ATTOR~"'Y, HE FORCED CONNECTIONS The District Board referred Mr. John A. Nejedly's letter to Mr. Bohn, Counsel for the District, and the staff. CLAIM OF FltANK SABATTE FOR DAMAGES Mr. Horstkotte, District Manager-Engineer, explained the damage to the Sabqtte home as a result of a sewer backing up. He reported that the claim was settled by the District's insurance carrier for in excess of $1,600.00, and recommended that the $500.00 deductible amount be paid to the District's insurance carrier. It ~~s moved by Member Roemer, seconded by Hember Gibbs, that the District pay the $500.00 deductible amount on the Frank Sabatte damage claim to Fireman's Fund Insurance Company, the District's insurance carrier. Continued to February 21,1963. CORRESPONDENCE FROl'1 THE CITY OF WALNUT CREEK AND OAK GROVE I'1ANOR INPROVEMENT ASSOCIATION RELATIVE TO ANÑUATIONS TO THE CITY AND THE DISTRICT After discussion, it was moved by Member Roemer, seconded by Member Fisher, that the request of the City of Walnut Creek and Oak Grove Manor Imorovement Association to allow annexations to the District by choice rather th~n the mandatory annexation at the time of annexing to the City be denied and the District staff be directed to write to the City pointing out the problems that would be involved for the District. Carried by the following vote: AYES : NOES: ABSENT: Members: Member: Member: Gibbs, Roemer and Fisher Mitchell Bowman }flATTERS FROM THE FLOOR PERMISS ION TO BUILD OVER SID-ŒR EASEMENT Mrs. Marcees Bisson stated that the Lafayette Fire Department had given her two weeks in which to build a ramp addition to her rest home on Brook Street in Lafayette and, in order to build the ramp, it would be necessary that a portion be built over an existing sewer easement. It was moved by Member Gibbs, seconded by Member Roemer, that Mrs. Marcees Bisson be granted permission to build a ramp addition to her rest home on Brook Street, Lafayette, subject to her signing an agreement to be prepared by Mr. Horstkotte, District Manager-Engineer, and Mr. Bohn, Counsel for the District. REPORTS DISTRICT MANAGER-ENGINEER DAI'1AGE TO DISTRICT FACILITIES DURDl1 RECENT STORM Mr. Horstkotte, District Manager-Engineer, reported on the damage to District facilities during the recent storm, the main damage being the exposing of Line G about one mile south of Walnut Creek, power line break at the Treatment Plant, Line A south of the Kepler property eÀ~osed, and Grizzly Creek crossing in the Burton area. PAYMENT FOR REBATE RIGHTS TO INSTALIERS OF SEWER IN FREITAS ROAD , DANVILIE Mr. Horstkotte requested authority to pay the installers of the line in Freitas Road, Danville, the sum of $15,087.50 in accordance with Resolution No. 1332 in purchasing their rebate rights. It was moved by Member Roemer, seconded by Member Gibbs, that $15,087.50 from Sewer Construction Expansion Funds be paid the installers of the Freitas 02 07 63 ('I"" Road Sewer in Danville in conformance with Resolution No. 1332, subject to the approval of Mr. Bohn, Counsel for the District. PETER FRUMENTI TO PAY DISTRICT FEES THROUGH TilE TITrE COMPANY UPON CLOSING Mr. Peter Frumenti requested that he be allowed to pay the necessary District fees on his projects through the Title Company upon closing. The District Board denied the request. CORRESPONDENCE WITH DUFFEL-SMOOT COMPANY HE CONNECTION CHARGES AND SERV ICE CHARGES Mr. Horstkotte called the Board's attention to correspondence with the Duffel-Smoot Company which is constructing several apartments for either rental or condominium and the problem of collecting the balance due after 10% connection charge deposits for apartments which later become condominiums which require full payment of connection charge rather than service charge. The matter was referred to Mr. Bohn, Counsel for the District, to take the necessary action to co11ect full connection charges. PROPERTY OWNERS IN LOCAL IMPROVEMENT DISTRICT NO. 42 AREA Mr. Horstkotte stated that certain property owners in the Local Improve- ment District No. 42 area would like to be included in the Local Improvement District No. 42 proceeding if their assessments would be limited to one unit. The matter was referred to Mr. Bohn, Counsel for the District. AUTHORIZATIONS FROM SEWER CONSTRUCTION FUNDS Mr. Horstkotte requested the following authorizations from Sewer Con- struction Funds: Ygnacio Valley Road Bypass Sewer, District Expense Relocation of Sewer in Trinity Avenue Relocation of Lines, Lincoln-Carmel Avenues Area #1 Lower Orinda Pump Station Modification, District Expense Treatment Plant Site Improvements Lines A through K, except G Line G, Sections 11 Thru 17, District Expense Watershed 23 Watershed 24 South Watershed 24 North Watershed 34 North $ 948.43 193.02 1,158.75 492.67 8,833.65 4,523.81 12,lh5.36 1,257.28 5,688.81 261. 76 130.95 It was moved by Member Fisher, seconded by Member Roemer, that $948.h3 for Ygnacio Valley Road Bypass Sewer, District Expense, $193.02 for Relocation of Sewer in Trinity Avenue, $1,158.75 for Rèlocation of Lines, Lincoln-Carmel Avenue Area #1, $12,145.36 for Line G, Sections 11 Thru 17, District Expense, $1,257.28 for Watershed 23, $5,688.81 for Watershed 24 South, $261.76 for Watershed 24 North, and $130.95 for Watershed 34 North be authorized from Sewer Construction General Funds, $492.67 for Lower Orinda Pump Station Modification, District Expense, and $4,523.81 for Lines A through K, except ~ be authorized from Sewer Construction Bond Funds, and $8,833.65 for Treat- ment Plant Site Improvements be authorized from Sewer Construction Expansion Funds.
