Diablo Boulevard, in the City of Waln~t Creek, County of Contra Costa, State of California at the hour of S:OO o'clock p.m. on the 4th day of November, 1948. The meeting was called to order by President Johnson, and the following roll was called: PRESENT: Members Smitten, Toland, Wadsworth, Weill and Johnson None ABSENT: APPOINT:'ENT OF SECRETARY PRO TEl-! Member Toland moved that Mrs. Phillips be appointed Secretary Pro Tern, seconded by Member Wadsworth, and carried unanimously. PROTEST OF PRESENCE OF MR. DUFTON Member Toland objected to the nresence of Mr. Mervin Dufton, who was at the meeting to take notes. President Johnson reQuested the Secretary to note the objection. READING OF MINUTES OF PREVIOUS MEETING It was moved.by Member Smitten, seconded by Member Wadsworth that the Board waive the reading of Minutes of the nrevious meetings, and that they be apnroved as entered. Carried unanimously. AHENm.lElJT OF BID DATE FOR LOCAL IMPROVEHENT DISTRICT NO.1 Discussion arose regarding changing the bid date for Local Improvement District No.1 from Janup~y 13 to December .2, 1948. President Johnson stated that had he been present at the meetin~ of October 21 he would have opposed the postponement of advertising for bids until January 13. The following resolution was offered by Member Wadsworth, seconded by Member Toland: RESOLUTION NO. 391 RESOLUTION AHENDING RESO:,UTION NO. 384 ORDERING lVORK IN LOCAL IHPROiTE1'IENT DISTRICT NO.1 BE IT RESOLVED that Resolution No. 384, adopted by this Board October 21, 1948, be and the same is hereby amended to read as follo'is, insofar as said Resolution No. 384 is inconsistent herewith: WHEREAS the District Board of Central Con~~a Costa Sanitary District, County of Contra Costa, state of California, passed and adopted, on 11 04 48 212 Se~tember 23, 1948, its Resolution of Intention No. 366, to do the work and improvement~erein described, to-wit: The construction of sani- tary sewers and appurtenances for the area within the boundaries des- cribed in said Resolution of Intention to the extent, 11ith the materials and in the manner set forth in said Resolution of Intention and according to Plans and Specifications heretofore adopted therefor, and WHEREAS all written nrotests filed in relation to said Droceed- ings '.¡ere duly considered. by said District Board, - RESOLVED by said District Board that said protests be and the same are hereby overruled, and RESOLVED that the public interest and convenience reQuire, and the said District Board hereby orders, that said work and improvement be done to-wit: The construction of sanitary sewers and anTIurtenances for the area ,.rithin the boundaries described in said Resolution of Intention, to the extent, l~ith the materials and in the manner set forth in said Resolution of Intention, and according to said Plans and Specifications, reference to which Resolution of Intention and Plans and Specifications is hereby made for a description of said work and improvement and the terms and conditions under \~hich the same is to be done. The Secretary of this Board is hereby directed to ,oat conspicu- ously for five (5) days, on or near the main entrance door to the reg- ular meeting place of said District Bop~d at 1822 Mt. ~iablo Boulevro~d, Walnut Creek, California, Notice hereof inviting sealed PROPOSALS OR BIDS fo~ doing said work and to publish twice a Notice hereof invit- ing sealed PROPOSALS or BIDS for doing said work and referring to the plans and specifications on file; the said publication to œ in the Lafayette Sun a daily newspaper, published and circulated in the Central Contra Costa Sanitary District and hereby c~esignated for that purpose. All such proposals shall be received by the Secretary at the Office of the District Board at 1822 Mt. Diablo Boulevard, vlalnut Creek, California, on the 2nd day of December, 1948 at 8:00 o'clock p.m., and said day is hereby designated as the day on which, at the hour of 8:15 o'clock p.m., said PROPOSALS or BIDS shall be opened, all of which shall be specified in said Notice, and said Notice shall reauire with said PROPOSALS or BIDS a check certified without qualifiêation by a responsible bank, payable to the Central Contra Costa Sanitary District for an amount not less than TEN PER CENT (10%) of the aggregate of the nroposal or by a bond for the said amount, and so payable signed by the bidder and two (2) sureties, all as prescribed by law. HAINES SEWER CONr.ECTION FEES It was moved by Member Weill, seconded by Member Toland that Helen A. Haines' request for a sewer connection for the property in Lafayette at !vIt. Diablo and Elizabeth street including El Charro Resturant and a drive-in to be built adjoining that resturant be ßranted, and that the fee be set at $500.00 plus normal inspection fees, with all cost of construction be borne by Mrs. Haines. Carried by the following vote: AYES: NOES: Members Toland, Wadsworth, Weill and Johnson. None I Member Smitten did not vote. REQUEST FOR PEffi~IT - A. G. MASCORELLA Mr. Mascorella requested ~ermission to connect to the oain trun~ line from the corner of Sherman Field where he p rop~ses to construct a drive-in res~rant. The Board withheld action pending further advice from the ßngineer. PFFICE OF DIST?.ICT HANAGER ~~e following resolution was offered by Member Toland, seconded by Member Weill: RESOLU'L'ION NO. 392 BE IT RESOLVED that the office of District Manager be and the same is hereby created to advise with this Sanitary Board in regard to adninistrative matters incident to the operation of the Dl.strict and its se\'Terage system and/or other vJ'Orks and to direct and su"Oervise the other employees of this District; BE IT FURTHER RESOLVED that the compensation of the nerson to fill such office shall be the sum of $750.00 per month. We have engineering layouts for the line to serve to the south line of your property and property descriptions for aquisition of easements have been forv!arded to the title company for search of titles. As soon as the property is acquired or basic agreements completed the construction dre.wings will be completed. O'Leary of the Vine Hill area advised the Board that they had almost coIDnleted the netition fbr annexation to the District, that the prea had an assessed valuation of $80,000. The Board asked that they have the necessary nape:'s nrepared, signed, checked and ready for nublication at the meeting of November 18. PROTEST REGARDING PETROLEUM SALES Mr. 1>1el Neilson of Lafayette addressed th Board as follov!s: That he opel'ates the Lafayette Tire Service and lives in Lafayette. That he had been informed that one netroleum distributor, who is a oember of the District Board, serves all tiJe contractors for t::'-~e District, and asked if the gasoline products could not be nut out for bid. President Johnson advised ~x. Neilson that the District can not put gasoline bids out because the Jistrict does not buy gasoline except for one truck uhich is m.med by the Di strict. Hr. Gumnertz of Stolte, Inc., advised the B08.rd that the reason they bought Sed.side gasoline ifas because that comDany served them on the job site, and they would be very happy to talk business with any oil comnany who gave them the same service. EHPLOYI :ENT OF MAINTENANCE HELPER The District Board authorized the employment of a helper for the maintenance crew at a salary of $225 per month to be raised to $250 at the end of 90 days. 11 04 48 ~16 The District Board authorized the nurchsse of a Shell Credit card for the truck. This Act contains no 'r'rovisions 'Vrhich requires 11 04 48 217 the District Board to publish a call for bids for the purchase of -::er- sona1 property. In the exercise of its discretion, however, the Board did call for bids for a 1/2 ton pickup truck. U~on examining the bids submitted, the Board determined that the specifications and the prices offered were unsatisfactory and, accordingly, rejected all bids, which it was legally authorized to do. "In order to obtain a truck which would meet specifications and price satisfactory to the Board, the Board purchased a truck on tne open market, ~mich it was authorized to do under the Sanitary District Act above mentioned.
