ITARi DISTRICT HELD JUNE 12.1952 The District Board of Central Contra Costa Sanitary District convened in adjourned session at its regular place of meeting lo- cated at 1822 Mt. Diablo Boulevard, City of Walnut Creek, County of Contra Costa, State of California, on June 12, 1952, at 8:00 o'clock p.m. The meeting was called to order by President Johnson and the roll was called~ PRESENT: ABSENT: Members Malott, Smitten, Toland, Wadsworth and Johnson None READING OF MINUTES OF PrtEVIOUS HEETING The ~rinutes of the previous meeting were read and were approved as entered. DISCUSSION OF 'rEE ACQUISITION OF THE HOOPER PROPERr.rY - TK:ATHENT PLANT Nember \JaclS'tvortll moved that the Board extend the lease of the Hooper property at the Treatment Plant for a period of one year. ' USE OF DISTRICT VEHICLES AFTER HOURS It was moved by Member Toland, seconded by Member Wadsworth, the.t the Board authorize the Se\.¡er Haintenance Superintendent and the Plant Superintendent to tal;:e District vehicles home after hours in order to cope with emergency conditions, and the ve~1ic1es are not to be used otherwise. Carried by the following vote: AYES: Hembers Smitten, Toland, i'Tads'tvorth and Johnson NOES: Member Malott. ABSENj;: None LAFAYETTE MEADOWS SErŒR - W. A. GABRIEL At the meeting of October 4,1951, Mr. W. A. Gabriel requested permission from the BoG,rd to collect connection fees from properties lyinG outside of LRfayette Meadows for connection to the sewer he he.d installed. The Board instructed l~r. Gabriel to furnish certified figures of costs, amounts he had collected from each lot, and the difference in cost if he had conne'cted to seviers in Local Improvement Di strict 3 instead of to I.lain Trunk Section V. Ml". Gabriel requested the Board to consider some reimbursement to him for the cost of the sewer, and was informed there was no way the District could reimburse him. Mr. Gabriel left a maD and some copies of invoices with the Engineer. The matter was heid over to the meeting of July 3, and Mr. Gabriel was told he would be notified. 06 12 52 r.ç :): !L> I'" CONNECTION TEffi1S ACALANES VALLEY UNIT 5 Boies and Soule requested a review of connection terms set in the amount of $1200 for Aca1anes Valley Unit 5 Lots 53 through 64 on the grounds that Lots 53 and 64 can not be served. It was moved by Member Wadsworth, seconded by Member Toland, and unanimous- ly c8.rried that Lots 53 and 64 be excluded, and the toteJ. conne c- tion fee be in the amount of $1,000.00 for Acalanes Valley Unit 5. LOCAL I~œROVEÞŒNT DISTRICT 26 SOUTH HORAGA Mr. William ID1odes presented a new petition, dated June 8, 1952, to the Board requesting that the Board institute proceedings to form a local improvement district for the construction of se't'lers in the area as outlined on the tracing entitled ilL. LD. No. 26 (proposed) South Horaga" dated June 10, 1952. The Engineer was instructed to determine the bo~aries, investigate the health situation and report to the Board at the meeting of July 3, .19.52. BUDGET FOR FISCAL YEAR 1952-53 President Johnson set a meeting for June 19, 1952 at 8:00 o'clock p.m., for the purpose of approving the budget for the fiscal year 1952-53. CONNECTION TEID1S - PARKMEAD UNIT 4 It,was moved by Member Toland seconded by Member Wadsworth, and unanimously carried that connection fee in the amount of $1,600 be set for Parkmead Unit 4, predicated on plans filed with the District on May 6 1952. CONNECTION TEID1S - BARRADAS SUBDIVISION It '(-¡as moved by Member Toland, seconded by }.lember Halott, and unanimously carried, that the Board set connection fee for Lots 1 to 10, Anita Court, Barradas Subdivision at $100 per lot. ' ORDINANCE NO. 16 - RESCINDING ORDINANCE NO. 15 - G.:è.RBAGE The following people, from the floor, requested the Board to rescind Ordinance No. 15 (Garbage ordinance): Messrs. S. H. HcAllister, Lafayette Improvement Club; E. 1. Spiegel R. J. Mitchell Gregory Gardens Improvement Club; J. A. Wagner Parkmead Improvement Club; K. J. Moore, Sans Crainte Unit 3; David A. Dolgin; R. W. Clack; Frank L. Dwinnell, Fair O~~s Home Owners; R. C. Corwin; James Tevens, Rudgear Road; Ralph H. Phelps, Miner- inð.a Property Owners' As sociation; George Hanson; B. F. Barro't.,rs; Harold Hayes, Happy Valley Improvement Association; Ronald A. Howard, Pleasant Hills and Pleasant Acres Improvement Associations; Ed Rowland; FrankSolvenger of Gregory Gardens Improvement Club; and a representative from the Lafayette Republican Women's Club. Ordinance No. 15 was read to the audience, and there ~'Tas aDDrox- imately two hours of discussion on the problem. Mr. Hayes.aSked that someone from the District come to the various improvement clubs and tell them of the additional funds the District needs to repair and operate the system. The Board informed the audience that any improvement club th8.t wanted information should leave their name. Member Smitten, seconded by Member 1<la1ott, moved the adopt'ion of Ordinance No. 16: ORDINANCE NO. 16 The District Board of the Central Contra Costa San1tary District does ordain as follows: That Ordinance No. 15 of the Central Contra Costa Sanitary Dist- rice be and the SÐ~e hereby is repealed, and all action taken pur- suant thereto includinG, and not limited to, calling for bids for an exclusive garbage franchise, rescinded. HALOTT Member Malott moved the adoption of a resolution that the Board members donate their services in the interests of economy, and eliminate fees to the Board and Secretary of the District. There was no second. Mr. Harold Fu~st asked why the District did not take advantage of the District Attorney's o1'1'ice instead of paying an Attorney $9,000 a year, and was told that the District Attorney would not handle all of the District' s legal problems, 'Local Improvement District proceedings being one of the major legal requirements thE.,t the District Attorney \,¡ould not furnish services for.
