HomeMy WebLinkAboutBOARD MINUTES 09-25-51 211 MINUTES OF AN ADJOURNED MEETING OF THE DISTRICT BOARD OF CENTRAL CONTRA COSTA SANITARY DISTRICT HELD SEPTEMBER 25, +951 The District Board of Central Contra Costa Sanitary District convened in adjourned session at its regular place of meeting lo- cated at 1822 Mt. Diablo Boulevard, in the City of Walnut Creek, County of Contra Costa, State of California, on September 25, 1951 at 8:00 o'clock p.m. The meeting was called to order and the roll was called: P?ESENT: ABSENT: Members Malott, Smitten, Toland, Wadsworth and Johnson Members - None READING OF MINUTES OF THE PREVIOUS MEETING The Minutes of the previous meeting were read and were approved as entered, with the following addition: In connection with the motion paying the lease to Hooper & Company, add - 'The Board instructed the Manager and the Attorney to contact the Hooper Company with regards to purchasing the land at present leased from that company." Page 203. HEARING PROTESTS AGAINST WORK AND ASSESSMENT LOCAL IMPROV~lENT DISTRICT NO. 21 Protest letters from the following property owners were read: Roy Satterthwaite, E. A. Patterson et aI, Elmer R. Schaefer, Will F. Morrish, John H. Lawrence, Earl L. Courtney, Frank E. Sellers, and Messrs. Woodman and Thorpe were heard from the floor. Mr. Satterthwaite by letter of September 24 withdrew his protest. E. A. Patte.son complained about the condition of Roberts Road and Douglas Court. The matter was held over pending the digging of test holes to determine the thickness of surfacing on the roads. The Engineer was to meet on the ground with the property owners. Also for investigation into the dedication of the street to the County. Mr. Schaefer objected to the assessment because he stated he had only three building sites. It was moved by Member Wadsworth, seconded by Iv.lember Smitten, that the protest be over-ruled. AYES: Members Smitten, Toland, Wadsworth and Johnson. NOES: Member ME!.lott. Messrs. Morrish and Lawrence had made enquiries only, which had been answered by the District Engineer. Mr. Courtney was advised that his protest would be investigated during the week. "Mr. Sellers objected to the assessment. It was moved by Member Toland, seconded by Member Smitten and unanimously carried, that the protest be over-ruled. The hearing was continued to October 4, 1951, 8:00 o'clock p.m. CIVIL SERVICE REINSTATE¥ÆNT LIST Member Wadsworth, seconded by Member Smitten, moved the adoption of Resolution No. 709: 09 25 51 112 RESOLUTION NO. 709 The District Board of the Central Contra Costa Sanitary Dist- rict does resolve as follows: That there shall be established a re-instatement list for each class or group of associated classes as approved by the District Board within the classified service. That in the event of reduction in personnel in such class, such reduction shall be effected in Order of seniority. That persons removed from employment shall have preference for future appoint~ents to the class or group of classes from which such person was removed, for a period of one year, or, longer as may be provided by the District Board. PASSED AND ADOPTED this 25th day of September, 1951, by the District Board of the Central Contra Costa Santary District by the following vote: AYES: NOES: ABSENT: Members Malott, Smitten, Toland, Wadsworth and Johnson Membe rs - none Members - None s/ Elliott Johnson, President of the District Board s/ H. Smitten, Secretary of the District Board JUNIOR COLLEGE SE\ŒR SERVICE DISCUSSION OF Mr. Drummond McCunn, Superintendent of the Junior College addressed the Board to the effect that they had now purchased the 100 acre site outside of the Sanitary District, had awarded a contract for construction of temporary buildings, and now wished to discuss sewer service terms. President Johnson advised Mr. McCunn that he was not in favor of giving service to the College as the treatment plant was nearing the time when enlargement would have to be considered to take care of the District as it exists. He called for an expression from the other Board members. Member Smitten was not in favor of giving service to the College. Member Malott was not in favor as it was equivalent to an annexation, which had been stopped for the present. Member Toland stated he would be in favor of it provided the College paid the ultimate cost now for their future full development. Member Wadsworth moved that the Board have the Engineer develop some exploratory avenues on which the Board could base an opinion. Motion was seconded by Member Toland. Motion defeated by the following vote: AYES: NOES: Members Toland and Wadsworth Members Malott, Smitten and Johnson President Johnson informed Mr. McCunn that it was useless to have the engineer prepare any survey until the Board decided whether or not it would be able to enter into a contract. Member Smitten moved that the Board not take the Junior College in at all. There was no second. 09 25 51 2Ja w~STERN PACIFIC RAILROAD REQUEST TO HAVE FENCE REPLACED The Engineer was instructed to notify P. & J. Artukovich, Inc., contractor for Local Improvement District No.4 to replace the fence removed on the eastern side of the railroad right of way southerly of Walden Road, which they had removed for construction operations. If not replaced immediately the District is to replace the fence and charge the cost to the monies due P. & J. Artukovich. REPAIRS TO BEECHWOOD COURT, LID 3 The Engineer was instructed to effect repairs to Beechwood Court with District funds not to exceed $275.00. REPAIRS TO UNNAMED ROAD LID 7 The Engineer was instructed investigate complaint from Newton E. Davis, determine the amount of the bid of O. C. Jones for repairs to the Unnamed Road in LID 7, and if the ditch area is in need of repairs to effect same. The District should do its own work apart from that done by the property owners or others; it was estimRted that the contractor had disturbed approximately 20% of the road area, for a distance of 600 feet. CONNECTION FEES SET PARKMEAD OAKS, UNIT 2 - James A. Ganley. It was movedqy Member Toland, seconded by Member Smitten and un~nimously carried that the Engineer's recommendation of $100 per lot for 47 lots be approved as connection fee. MASON-McDUFFIE (TOCAN CORP, O\~ER) Portion Lots 122 & 156, Orchard Road. It was moved by Member Toland, seconded by Member Smitten and unanimously carried, -that connection fee for this property be set at $100. per single building site. EL RANCHO DIABLO - K. L. Lincoln - 41 lots. Recommended $100 per lot. This matter was held over for further study, as Mr. Lincoln appeared before the Board stating that he could not add any add- i tlorl""amount to the sale price of his houses, and had been given to understand a year ago there would be no further charge. ../ GARIBOTTI PROPERTY near Planter's Dock. At the meeting of October 5, 1950 the Board set connection fee at $1)4. for the 1.1 acre parcel, consisting of two building sites. The property now con- sists of four building sites. It wac moved by Member Smitten and seconded by Member Toland that this property be charged $100 for each building site in addition to the two sites that were set at $134. AYES: Members Smitten, Toland, Wadsworth and Johnson. NOES: Member Malott. EXPEDITING PUMPS FOR ORINDA PLANTS Mr. Nejedly was given authority to travel to Washington if necessary to expedite delivery of the pumps and shafts for the Orinda Pumping Stations. LANDSCAPING AT TREATMENT PLANT It was moved by Member Wadsworth and seconded by Member Toland that the Board authorize the Engineer to commence the landscaping development at the Treatment Plant at a cost not to exceed $500. Carried by the following vote: AYES: Members Smitten, Toland, Wadsworth and Johnson NOES: Member Malott 09 25 51 114 PAYMENT FOR EASEMENT LID 22 PARCEL 22 It was moved by Member Wadsworth, seconded by Member Toland, and unanimously carried that payment of $50. be made to Francis J. Carr et ux, for easement Parcel 22 of Local Improvement Dist- rict No. 22. ADJOURNMENT President Johnson adjourned the meeting to October 4, 1951 at 8:00 o'clock p~m. ~.
