HomeMy WebLinkAboutBOARD MINUTES 11-21-50 52 MINUTES OF AN ADJOURNED MEETING OF THE DISTRICT BOARD OF CENTRAL CONTRA COSTA SANITARY DISTRICT HELD NOVEMBER 21, 1~50 The District Board of Central Contra Costa Sanitary District convened in adjourned session at its regular place of meeting lo- cated at 1822 Mt. Diablo, Boulevard, in the City of Walnut Creek, County of Contra Costa, State of California, on November 21, 1950 at 8:00 o'clock p.m. The meeting was called to order by President Johnson, and the following roll was called: PRESENT: ABSENT: Members Malott, Smitten, TolRnd and Johnson Member Wadsworth READING OF MINUTES OF PREVIOUS MEETING The Minutes of the previous meeting were read and were approved as entered. OPENING BIDS FOR WORK OF L.I.D. 20 STRANDWOOD ESTATES Three bids were received for the work of Local Improvement District No. 20, from the following: Kevry Construction Compsny James Hill Cal-Neva Construction Company The Engineer's estimate was $5,860.00 ),216.70 4,850.40 4,165.00. AWARD OF CONTRACT LID 20 The Engineer recommended award of contract to James Hill, as the lowest responsible bidder. Member Toland, seconded by Member Smitten, moved the adoption of Resolution No. 666: RESOLUTION NO. 666 WHEREAS, the District Board of the Central Contra Costa Sanitary District did in open session, on the 21st day of November, 1950, publicly open, examine and declare all sealed proposals or bids for doing the work and improvement described in Resolution of Intention No. 658 for the construction of sewers and appurtenances in Local Improvement District No. 20 in the Central Contra Costa SRnitary District, adopted on the 5th day of October, 1950, which Resolution of Intention is hereby expressly referred to for a description of said work and improvement and for all particulars relative to the proceedings under said Resolution of Intention; NOW, THEREFORE, IT IS HEREBY RESOLVED, that the District Board of the Central Contra Costa Sanitary District hereby rejects all of said proposals or bids except that herein mentioned, and hereby awards the contract for doing said work and making said improvements to the lowest responsible bidder, to-wit: JAMES HILL at the prices named in the bid of said bidder on file in the office of the Secretary of the District Board. The Clerk of the District Board is her~by directed to publish notice of said award twice in the Courier-Journal, a newspaper . 11 21 50 53 published and circulated in said Sanitary District, and designated for thAt purpose by said District Board of the Central Contra Costa Sanitary District. CONFIRMING PROCEEDINGS AND ASSESSMENT LOCAL IMPROVEMENT DISTRICT NO.9 Member Smitten, seconded by Member Toland, moved the adoption of Resolution No. 667: RESOLUTION NO. 667 WHEREAS the District Engineer of Central Contra Costa Sanitary District of Contra Costa County, State of California, filed with the Secretary of said District, on October 18, 1950, an Assessment, to- gether with a Diagram and Engineer's Certificate attached thereto, to represent the costs and expenses of constructing sanitary sewers and appurtenances pursuant to Resolution of Intention No. 569, adopted by the District Board of said Sanitary District on April 18, 1950, and in that portion of said pistrict described therein as Local Improvement District No.9, to which Resolution of Intention.reference is hereby made for a description of said work and improvement and the district to be assessed for the costs and expenses thereof, and for all other purposes; and WHEREAS said Secretary gave due notice as required by law"of the filing of said Assessment, and that Thursday, the 16th day of November 1950, at 8:00 o'clock p.m., on said day, and the meeting place of said District Board at 1822 Mt. .Diablo Boulevard, in the City of Walnut Creek, in said County, had been duly fixed as the time and place for the hearing on said Assessment; and WHEREAS said District Board held such hearing at the time and place so fixed therefor, snd then and there, and at contimlances of said hearing regularly had, received evidence, oral and documentary upon said work done, and upon said Assessment, and Diagram and Engineer's Certificate attached thereto, , and also then and there considered all appeals theretofore filed pursuant to law with said , B9ard by persons interested in said work and said Assessment; WHEREAS said District Board has examined said Diagram and Assess- ment and is satisfied with the correctness thereof, except as herein- after ordered, and that no correction or modification thereof should be made, except as so ordered; NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED by said District Board that all acts and. determinations of said District Engineer relative to said work done pursuant to said Resolution of Intention be and the same are hereby approved, ratified, and confirmed, and said District Board does hereby approve, ratify, and confirm said DiAgram and Assessment, except as hereinafter provided. (2) To the Assessment Diagram shall be added a new Assess- ment(Parcel/Lot)No. 9-11-9, which shall include the easterly 125.0 feet of the westerly 278.73 feet of original assessment (Parcel/Lot) No. 9-11-3 and the assessment on said(Parcel/Lot)No. 9-11-9 shall be $247.00, (3) To the Assessment Diagram shall be added a new Assessment ~arcel/Lot)No. 9-11-10, which shall include the westerly 100.02 feet, facing Walnut Boulevs,rd, of the easterly 110.37 feet, facing Walnut Boulevard, of original assessment(Parcel/Lot)No. 9-11-3 and the assessment on said(Parce1/Lot)No. 9-11-10 shall be $247.00. Ii 21 50 55 (9) To the Assessment Diagram shall be added a new Assessment {Parcel/Lot} No. 9-17-13 which shall include only the following portion of original assessment (Parcel/Lot) No. 9-17-3; beginning at the northeasterly corner of said original assessment (Parcel/ Lot) No. 9-17-3 and the southerly boundary of Mountain View Boule- vard thence S 680 42' 30" W along said southerly boundary of Mountain View Boulevard 210 feet; thence from said point of beginning S 240 8' 30" E 217.79 feet; thence S 680 42' 30" W 76.72 feet; thence N .590 29' 10" W 40.23 feet; thence N 240 08' 30" W 194.15 feet to the southerly boundary of Mountain View Boulevard; thence along the southerly boundary of said Mountain View Boulevard 100 feet to the point of beginni, and the assessment on said (Parcel/Lot) No. 9-17-13 shall be 247.00. (10) To the Assessment Diagram shall be added a new Assessment (Parcel/Lot) No. 9-17-14 which shall include only the following portion of original assessment (Parcel/Lot) No. 9-17-3; beginning at the northwesterly corner of said original assessment (Parcel/Lot) No. 9-17-3 and the southerly boundary of Mountain View Boulevard thence N 680 421 30" E along said south8rlY boundary of Mountain View Boulevard 248.96 feet; thence S 24 081 30" E 194.15 feet; thence S 550 09110" W 219.01 feet to a point on the easterly boundary of San Miguel Drive 153 feet to the point of beginning and the assessment on said (Parcel/Lot) No. 9-17-14 shall be $494.00. Said District Engineer is hereby directed to correct and modify said Diagram andAssessments accordingly. BE IT FURTHER RESOLVED AND ORDERED that said Diagram and Assess- ment as so changed and corrected are hereby approved, ratified and confirmed. M. Smitten, Sècretary of the District Board OPENING HEARING ON ASSESSMENT LOCAL IMPROVEMENT DISTRICT NO.1? President Johnson opened the hearing of protests against the work and assessment of Local Improvement District No. 17. Letters were received and read from the following: Frank W. Draeger, Josephine E. Young, Richard E. Lee, Carl S. Win- quist, and William J. Hanley. The protests of Josephine E. Young, Oa.rl S. . Winquest and William J. Hanley were over-ruled. The protests of Frank W. Draeger and Richard E.. Lee were held for further inspection and investigation. President Johnson continued the hearing for Local Improvement Dist- rict No. 17 to December 7,1950, at 8:00 o'clock p.m. MARTY LANE - L.I.D.
