Diablo Boulevard, City of Walnut Creek, County of Contra Costa, state of California, on June 22, 1950, at the hour of 8:00 o'clock p.m. The meeting was called to order by Secretary Smitten and the following roll was called: PRESENT: ABSENT: Members Cornwall, Smitten, Toland and Johnson Member Wadsworth ACTING PRESIDENT With the approval of the members present, Member Johnson was appointed Acting President in the absence of President Wadsworth. READING OF THE MINUTES The Minutes of the previous meeting were read and were approved as entered. HEARING ON RESOLUTION OF INTENTION LOCAL Ilv1PROVEI.1ENT DISTRICT, N.O. 18 There were no .written protests against the proposed work of Local Improvement District No. 18. Acting President Johnson asked if there was anyone present who Trlished to be heard reg,arding the proposed work. The following persons expressed themselves as to the extent of the district to be assessed and the location of the work: Messrs. August Vecchi and P. O. Davidson and ~~s. Freda BroTl'm. Member Smitten, seconded by Member Cornwall, moved the adoption of Resolution No. 6°5: ' RESOLUTION NO. 605 RESOLUTION ORDERING WORK, DETEro~INING PREVAILING RATE OF WAGES, AND DIRECTING NOTICE TO BIDDERS IN LOCAL IHPROVE1-1ENT DISTRICT NO. 18 WHEREAS, the District Board of the Central Contra Costa Sanitary District, County of Contra Costa, State of Cal~rnia, did on the 1st day of June,' 1950, adopt its Resolution of Intention No. 594 to order the therein described work and imnrovement to be done and made in Local Improvement District No. 18 which Resolution of Intention was duly and legally published in the time, form and manner as required by law, as sho~m by the affidavit of publication of said Resolution of Intention on file in the office of the Secretary of said Central Contra Costa Sanitary District; and WHEREAS, after the adoption thereof, notices of the passage of said Resolution of Intention, headed "Notice of Improvement", were duly and legally posted in the time, form, manner, locations and number as required by law, as appears from the affidavit of posting said notices, on file in the office of the Secretary of said Central Contra Costa Sanitary District; and WHEREAS, after the adoption thereof, notices of the adoption of said Resolution of Intention were duly mailed to all persons owning real property proposed to be assessed for~e improvements described in said Resolution of Intention according to the names and addresses of such owners, as the same appear on the last equalized assessment roll for County Taxes prior to the day of such mailing or as known to the Clerk of the Board of the Central Contra Costa Sanitary Dist- rict, which said notices were duly mailed in the time, form ,and manner as required by law; and 06 "22 50 146 WHEREAS, the District Board of the Central Contra Costa Sanitary District having duly received and considered evidence oral and docu- mentary concerning the jurisdictional facts in this proceeding and concerning the necessity for the contemplated work and improvement and the benefits to be derived therefrom, and all protests file in relation to said proceedings were duly considered by said District Board, found to be made by owners of less than one-half of the area of the property to be assessed for the improvements, and are hereby ordered 'overruled, and said District Board having now acquired juris- diction to order the proposed improvement, IT IS HEREBY RESOLVED, by the District Board of the Central Contra Costa Sanitary District, County of Contra Costa, State of California, that the public interest and convenience require the improvement herein referred to, and said, District. Board hereby orders: that the TrTork and improvement, as set for1ïh and described in .said Resolution of Intention, and in'the plans and specifications therein referred to, to be done and made. RESOLVED FURTHER, that the boundaries of the assessment district, and the grades to which said work and improvements are to be constr- ucted, shall be those set forth and described in said Resolution of Intention, and in the plans and specifications therein referred to, reference to ~Thich is hereby made for all further particulars. RESOLVED FURTHER, that the Secretary of said District Board shall post conspicuously for five (5) days, on or near the main entrance door to the regular meeting place of said Board at 1822 Mt. Diablo Boulevard, Walnut .Creek, California, a Notice to Bidders, in the. form hereinafter stated, inviting sealed proposals or bids for doing said '\fork and referring to said Plans and Specifications on file; and shall publish said Notice twice in Courier Journal, a news-. paper published and circulated in Central Contra Costa Sanitary District and hereby designated for that purpose. The fore~oing schedule of prevailing rates of wages, and rates for overtim~, Sunday and Legal Holidays, is based, unless otherwise specified, upon a working day of eight lS) hours. 06 .22 50 40 1 c Overtime. and Saturday rates for Truok Drivers shall be at one 'and one-half (l!) times the normal hourly rate. ' . The first t.wo hours overtime, after a normal eight (8) hour day, for Cement Finishers shall be at one and one-half (It) times the normal rate and further overtime shall be at double the normal rate. Saturday work for Cement Finishers shall be at one and one-half (It) times the normal rate for the first eight (8) hours worked and at double the normal rate for all further time worked on Saturdays. . NOTICE IS ALSO HEREBY GIVEN 'BIDDERS that it shall be mandatory upon the contractor to whom the contract is awarded, and upon all sub-contractors under him, to pay not less than said general pre- vailing rates of per diem wages, as above listed, to all laborers, workmen and mechanics em~loyed in the execution of the contract. Anything to the contrary in the above wage scale nott'lithstanding, the Contractor and all 8ubcontractors under him shall pay all their laborers, l-Torkmen, mechanics and employees on said work a salary or wage at least equal to the prevailing salary or wage for the same quality of service rendered~ private persons, firms or corporations under similar employment, within the Central Contra Costa Sanitary District. The per diem wage rate is the hourly rate hereinabove mentioned established multiplied by the number of hours hereinabove mentioned as constituting the working day for the particular craft or type of workman. Before.submitting proposals the bidder shall be licensed in accord- ance with the provisions of Chapter 9 of, Division III of the Business and Professions Code, Chapter 37 of the statutes of 1939, as amended, of the State of California, which provides for the registration and licensing of contractors. Each bidder must submit with his proposal, a statement of his financial responsibility, technical ability and experience on the form to be furnished prospective bidders. Each bidder shall submit with his bid on the form ~rovided, the name and address of each subcontractor including the principal suppliers of materlals,and the portion of the work which each sub- contractor will do. If the contractor fails to name the subcontract- ors in his proposal, he sahll be deemed to have agreed to perform. such portion of the work himself and shall not be permitted to sub- contract said portion of work without previous written permission of the Di~rict Board. ' The Contractor shall, in the performance of the work and improve- ments, conform to the labor Code of the State of California and other laws of the state of California applicable thereto, with the exception only of such variation as may be required under the special statutes pursuant to which proceedln~s hereunder are taken and which ha~e not been superseded by the provisions of the Labor Code. Per- ference to labor shall be given only in the manner provided and re- quired by law. Veterans and resident local labor shall be given preference by the Contractor wherever possible, if skill and working ability permit without increasing theu1tlmate cost of the work and improvement to the Local Improvement District, the Central Contra Costa Sanitqry Dle~rict and its officers. All proposals or bids shall be accompanied by a check payable to $id Central Contra Costa Sanitary District and certified by a responsible bank for an amount which -Shall not be less than ten (10~) percent of the a ggregate of the proposal, or by a bond for said amòunt and so payable, signed by the bidder and two sureties, who shall justify, before any officer competent to administer an oath, in double the said amount and over and above all statutory exemptions. Diablo Blvd., Walnut Creek, Contra Costa County, State of California, said time being not less than ten (10) days from the time of the' first publication or posting of said Notice. Bids will be opened on said day and hour. The District Board reserves the right to reject any and all proposals or bids, should it deem this necessary for the public good, and also the bid of the bidder who has been delinquent o~ unfaithful in any former contract with the Central Contra Costa Sanitary District. All bid's shall be submitted on the understanding that all work thereunder shall be done pursuant to the Improvement Act of 1911 and that all of the applicable requirements thereof shall be made a part hereof, of the Local Improvement District proceedings, the bonds and the contract. RESOLUTION NO. 607 RESOLUTION PROPOSING TO AI.œND RESOLUTION OF INTENTION NO. 569 AS TO THE HEREIN DESCRIBED PARTICULARS FIXING THE TIME AND PLACE OF HEARING ON THE PROPOSAL TO AHEND SAID RESOLUTION AND DIRECTING THE CLERK TO GIVE'NOTICE OF SAID HEARING WHEREAS, Resolution of Intention No. 569 for the construction of sewers and appurtenances in Local Improvement District No.9 did provide that the whole territory included within such Local Improve- ment District should be assessed to pay the cost and expense thereof.
