Diablo Boulevard, in the City of Walnut Creek, County of Contra Costa, State of California, at the hour of 8:00 o'clock p.m., on Mar~h 2, 1950. z",. The meeting waS called to order by President Wadsworth and the following roll waS called: PRESENT: ABSENT: Members Johnson, Smitten, Toland, Cornwall and Wadsworth Members - None READING OF MINUTES OF PREVIOUS MEETING The Minutes of the previous meeting were read and were approved as entered. REQUEST TO DUMP SEPTIC TANK EFFLUENT AT TREATlviENT PLANT Letter of February 23, 1950, from Messrs. W. C. Paine and D. K. Young requested the Board to consider providing facilities at the plant for the disposal of septic tank effluent. The Board instructed the Manager to get further information, and to advise Messrs. Paine B,nd Young that a study will be made and they will be advised of the decision before the next critical season. >-" REQUEST FOR EXTENSION OF TIME - LID 14 UNDERGROUND CONSTRUCTION CO. By ¡etter of March 1, 1950, Underground Construction Company requested an extension of time to May 15, 1950, for completion of work in Local Improvement District No. 14. It was moved by Member Cornwall, seconded by Member Toland and unanimously carried that the Board grant an extension of time' to April 1, 1950, inclusive, upon their signed agreement to pay all additional inspection costs incurred by the Sanitary District, and to allow licensed contr~ctors and plumbers other than themselves to make house sewer connections. APPROVING ASSESSMENT DIAGRAM LOCAL Ir'ÆPROVEMENT DISTRICT NO.4 Member Smitten, seconded by Member Toland, moved the adoption of Resolution No. 542: RESOLUTION NO. 542 RESOLVED by the District Board of Central Contra Costa Sanitary District o,f Contra Costa County, State of Celifornia, that the Diagram, made by the District Engineer of said Sanitary District and presented to said District Board, of the district to be assessed for the costs and expenses of constructing sanitary sewers and appurtenances in Loca~ Improvement District No. 10, and in the public streets, drives, rights of way, easements and reserves there- in, in said Sanitary District, as provided in Resolution of Intention No. 432, adopted by said District Board on March 31, 1949, be and the same is hereby approved, and the Secretary of said District Board is hereby directed to certify the fact and date hereof and so notify said District Engineer. Smitten, Secreta,ry REQUEST FOR INFORMATION ON COST GLORIETTA AND MORAGA MEADOWS ASSOCIATION By letter of February 16, 1950, the Glorietta Improvement Assoc- iation and Moraga Meadows Association requested estimate of cost to each property owner for the installationd sewers, and when work could be started and completed if they requested the installation. The Manager was instructed to reply to the letter, giving an estimate of the general over-all cost and approximate. t,ime the work could begin. ORDER OF DISTRICT BOARD ALAMO DANVILLE DIABLO ANNEXATION ELECTION Member Toland, seconded by Kember Smitten, moved the following order ,be spread upon the Minutes. Carried unanimously. The District Board of the Central Contra Costa Sanitary District having heretofore determined the result of the election held on February 7,1950, upon the petition and proposition to annex contig- uous lands in Alamo, Danville and part of Contra Costa County, and that result being against such annexation, said petition is hereby ordered disapproved. ADOPTING WAGE SCALE - SECTION VII Member Smitten, seconded by Member Toland, moved the adoption of Resolution No. 545: RESOLUTION NO. 545 WHEREAS, in pursuance of Section 1773 of the Labor Code of the State of California, before the District Board of the Central Contra Costa Sanitary Distridt may award any contract for public work on behalf of Sanitary District, the District Board must ascertain the general prevailing, rate of per diem wages in the locality in which th~ work is to be performed, to-wit: within the limits of the Central Contra Costa Sanitary District for each craft or type of workman or mechanic needed to execute the contract, and must specify in the call for bids for said contract and in the contract itself what the general prevailing rate of per diem wages in said locality is for each craft or type of workman or mecha,nic needed to execute the contract and also the general prevailing rate for legal holiday and over-time work; NOW, THEREFORE, BE IT RESOLVED, that the said general prevail- ing rate of per diem wages and the general prevailing rate of per diem wages for legal holiday B,nd overtime work within the limits of said Sanitary District for each craft or type of workman or mechanic needed to execute a contract for the construction of Main Trunk Section VII and Moraga Pump Station No. I and shall be and ,the same are hereby ascertained, approved and adopted by this Dist- rict Board after a full investigation to be as follows: 03 02 50 CLASS OF WORK Boiler Maker (Foreman) - Boiler Maker & Boiler Maker-Welder, Brick Layer Brick,Layer (Hod-carrier) Carpenter (Foreman) Carpenter (Journeyman) Carpenter (Millwright) Cement Finisher (Foreman) Cement Finisher. B,nd work on Sundays and Holidays shall be paid for at double thenorma¡ hourly rate. , The foregoing schedule of prevailing rates of wages, and rates for overtime, ,Sunday and Legal Holidays, is based, unless other- wise specified, upon a working day of 8 hours. . Overtime and Saturday rates for Truck Drivers shall be at one and one-half (It> times the normal hourly rate. " The first,two hours overtime, after a normal 8 hour day, for Cement Finishers sha,ll be at one and one-half (Ii) times the normal rate and further overtime shall be at double the normal rate. Saturday work for Cement Finishers shall be at one and one- half (li) times the normal rate for the first 8 hours worked and at double the normal rate for all further time worked on Saturday.s . Notice is,also hereby given bidders that it shall be manda~ory upon the contractor to whom the contract is awarded, and upon all 'subcontractors underhim, to pay not less than said general prevail- ~ng rates of per diem wages, as above listed, to all laborers, workmem and mechanics employed in the execution of the contract. Anything to the contrary in the above wage scale notwithstanding, the Contractor and all Subcontractors under him shall pay all their laborers, workmen, mechanics and employees on said work a salary or wage at least , equal to the prevailing salary or wage for the same quality of service rendered to private persons, firms or corpora- tions under similar employment, within the Central Contra Costa Sani tary District. Wadsworth, President 03 02 50 223 CALL FOR BIDS - SECTION VII ,Member Cornwall, seconded by Member Smitten, moved the adoption of Resolution No. 547: RESOLUTION NO. 547 ,WHEREAS, in the judgment of the District Board of the Central Contra Costa Sanitary District it is necessary to secure all labor,' materials, equipment, mechanical workmanship, transportation and services required for the construction of the Main Trunk Section VII and,Moraga Pump Station No. I in accordance with the plans and spec- ifications for.the Same prepared by the District Engineer which are on tile in the Office of the Sanitary District located at 1822 Mt. Diablo Boulevard., tÞlalnut Creek, CR,lifornia; NOW, THEREfORE, BE IT RESOLVED, that the general prevailing rates of wages as heretofore ascertained and determined by this Board in its. Resolution No. 545 adopted on the 2nd day of March, 1950, in pursuance to the Labor Code of the State ,of California shall be the general prevailing rates of per diem wages for each œaft or type of workman or mechanic needed for the construction of said Main Trunk Section VII and Moraga Pump Station No. I; and, .BEIT FURTHER RESOLVED, that the Secretary of this Board be and is hereby authorized to advertise for proposals for the construction and completion of said work by publishing the same once in the. Before submitting proposals the bidder shall be licensed in accordance "'lith the provisions of Chapter 9 of Division III of the Business and Professions Code, Chapter 37 of the Statutes of 1939, as amended, of the State of California, which provides for the registration and licensing of contractors. Each bidder must submit with his proposal, a statement of his financia,l responsibility, technical ability and experience on the form to be furnished prospective bidders. Each bidder shall submit with his bid on the form provided, the name and address of each subcontractor including the principal suppliers of materials, and the portion of the work which each sub- contractor will do. If the contre,ctor fails to n~,me the subcontractors in his proposal, he shall be deemed to have agreed to perform such portion of the'work himself and shall not be permitted to subcontract said portion of work without previous written permission of the District Board. . The proposal shall be made out on the form to be furni shed prospective bidders, a copy of which is incorporated with 'the spec- ifications and must be accompanied by a certified or cashier's check or bidder's pond for an amount not less than ten (10) per cent of the aggregate of the proposal, made payable to the Central Contra Costa Sanitary District, sealed and filed with the Secretary thereof on or before the day and hour first above set forth, and thereafter will be publicly opened and read before said District Board. , The above mentioned check or bond shall be given as a guarantee that the bidder or his heirs will enter into contract if awarded the work, within ten (10) days after notice of the award has been sent to him by mail at the address given by him in his proposal and said check or bond shall be declared forfeited if the bidder refuses or neglects to enter into said contract within said time. The successful bidder will be required to furnish labor and material bonds in the amount of fifty (50) per cent of the contract pricè and a faithful performance bond in an amount equal to one hundred (100) per cent of the contract price. . AUTHORIZING DISTRICT PAYYÆNT~ CLEVERDON CO. FOR LOCAL IMPROVEMENT :DISTRICT NO. 16 Member Toland, seconded by Member Johnson, moved the adoption of Resolution No. 548: RESOLUTION NO. 548 WHEF~AS the District Board of Central Contra Costa Sanitary District provided by its Resolution of Intention No. 465 relative to Local Improvement District No. 16 that there shall be paid out of the Sewer Construction Fund the sum of Two Thousand Five Hund- red and No/lOOths Dollars ($2,500.00) toward the cost and expense of the work and improvement described in said Resolution of In- tention; and ' WHEREAS said work and improvement has been completed by Cleverdon Co., Inc., the contractor to whom the contract for said work was duly awarded and by whom said work was done, and the Assessment for the costs and expenses thereof was approved, ratified a,nd confirmed by this Board by its Resolution No. 536 duly adopted on the 26th day of rJanuary, 1950; NO t'l, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED th~,t the sum of Two Thousand Five Hundred and No/lOOths Dollars ($2,500.00) be forthwith paid to Cleverdon Co., Inc., and that the President and Secretary be and they are hereby authorized and directed to execute a warrant in said sum drawn on the Sewer Construction Fund of Central Contra Costa Sanitary District and payable to Cleverdon Co., Inc., PASSED AND ADOPTED by said District Board of Central Contra Costa Sanitary District, Contra Costa County, State of California, this 26th day of January, 1950, by the following called vote: AYES: NOES: ABSENT: Members Johnson, Smitten, Toland, Cornwall and Wadsworth Members - None Members - None .s. Harrison $420.12 420.11 28,,210.09 tije balance of said sum for incidental expenses to be deposited to the credit of the Running Expense Fund of Central Contra Costa Sanitary District to reimburse said fund for monies heretofore advance.d for incidental expenses incurred by the Sanitary Distrlct for Local Improvement District No. 10 and for which the Sanitary District has not previously received payment, and to pay further costs for incidental expenses for Local Improvement District No. 10 as bills for such expenses are received and authorized for payment by the District Board after approval by the District Manager and audit by the Board. Th,e President and Secretary are hereby authorized a,nd directed to execute the necessary warrants to pay the charges above mentioned. AUTHORIZATION TO INSTALL GAS TANK It was moveq by Member Cornwall, seconded by Member Toland, and unanimously carried that the Board authorize the Manager to proceed with installation of bulk underground storage tank and gasoline dispensing electric pump. REQUEST FOR ACCEPTANCE OF LID 3 , The Engineer requested the Board, to consider acceptance of wo~k of Local Improvement District No.3, with the contractor signing a supplemental agreement and depositing $5,000 with the D1.strict to cover completion of the work. It was moved by Member Smitten, seconded by Member Cornwall, an~ unanimously carried that the Engineer return the cashier's check in the amount of $5,000 to Downer Corporation, and that Downer Corporation be advised that the Board does not approve en~ering into any supplemental agreement. SEWER CONNECTION FOR COUNTY JUVENILE HOME , " . The Board instructed the Engineer and the Attorney to work on the problem of the sewer connection for the County Juvenile Ho~e into the sewers of the Pacheco improvement District. PAYMENT OF BILLS . It was moved by Member Cornwall, seconded by. Member Toland, an~ unanimously carried that the bills approved by the Manager and audited by the Auditing Committee be paid. That all additional inspection costs incurred by the District by reason of such extension of time be paid for by ,the contractor to the District, and 2.: That property owners be perm i tted to select any contractor to install side sewer connections, and that such connections by such selected contractors may be made from the date of granting the extension.
