HomeMy WebLinkAboutBOARD MINUTES 10-16-58 30 MINUTES OF AN ADJœRNED RæJLAR MEETING OF THE DISTRICT BOARD CENIRAL CCfi'lRA COSTA SANITARY DISTRICT HELD OCTOBER 16, 1958 The District Board of Central Contra Costa Sanitary District convened in an Adjourned Regular Session at its regular place of meeting located at 1250 Spring- brook Road, Walnut Creek, County of Contra Costa, State of California, on October 16,1958, at 8:00 o'clock P.M. The meeting was calledb order by President Fisher. ~ I. ROLL CALL PRESENT: Members: Mitchell, Roemer, Salfingere and Fisher ABSENT : Member: Spiegl II. APPROVAL OF MINUTBS It was moved by Member Rôemer, seconded by Member Salfingere, that the Minutes of the meeting of October 2, 1958, be approved subject to the following correction: Under VII. REPORTS, DISTRICT MANAGER-HiGINEER, RELIEF VALVE, the first sen- tence to read as follows: "Mr. Horstkotte suggested that an application be made for a patent on the relief valve developed by District personnel and now a part of the District's speci- fications". Motion correcting the Minutes carried by the following vote: AYES: NOES: ABSENT: Members: Mitchell, Roemer, Salfingere, and Fisher Members: None Member: Spiegl ~ III. APPROVAL OF BILLS None. IV. HEARINGS None. V. OLD BUSINESS APPOINTMENT OF MR. JOHN A. BOHN AS CaJNSEL FOR THE DISTRICT Mr. Horstkotte, District Manager-Engineer, introduced Mr. John A. Bohn and asked that a determination be made by the District Board for his employment as Counsel for the District. Following an Executive Session, President Fisher stated the Board was offering the position of Counsel for the District to Mr. Bohn at the salary mentioned in the prospectus sent to him. Mr. Bohn accepted the position. BROWN AND CALDWELL REPORT RE œTFALL SEWER ~ Mr. Horstkotte, District Manager-Engineer, introduced Dr. David H. Caldwell and Mr. Guy Anderson of Brown and Caldwell. Dr. Caldwell stated that the firm of Dames & Moore had been Ø!tained by Brown and Caldwell to check foundations and put down borings in the Outfall Sewer area and, on the results of th08e tests and a final report from Dames & Moore, the line was designed. He further stated that Mr. Fred Bolus was retained for a report on ~O 18 5.8 - 31. the submarine section of the line. Member Roemer said the Board Members were most interested in Schedule III because of the openings between the pipe sections and wished to know whetbe r the openings were caused by the contractor's work or not. Dr. Caldwell presented copies of a report fIOm Dames & Moore and said some tolerance was permitted but the exact reason for the settlement of the pipe was still in question. , ) Member Roemer stated he was thinking directly in terms of liability and felt the District, under the contract, was entitled to have M.G.M~ Construction Co. remove and replace: 'any pipe that had separated more than 5/8 of an inch. ~ .Dr. Caldwell said that, if the foundation was causing the trouble, it would not be the contractor's responsibility and the manufacturer's tolerance was about 7/8 of an inch. Dr. Caldwell said the sections are not opening any more and some are closing up. Mr. Guy Anderson explained aboút the settling of the pipe. In reply to Member Mitchell's question, Dr. Caldwell stated the pipe people were investigating and still believed the gasket would do the job. He further said there was a softer area coming up and one of the partners of Dames & Moore would be on the job and supervise. Member Mitchell asked Dr. Caldwell if. progress payments were being approved for the work which has been done and which has separated. " , Mr"Nejedly, Couns~ for the District, said that if the contractor was not responsible, it would be' all right to make progress payments, but, if it was known there was a defect and the work had not been done in accordance with the plans and specifications, no payment should be made. , ) Dr . Caldwell said some of the work was not done precisely: as the specifi- cations called for. Mr. Horstkotte, District Manager-Engineer, reported that the pipe manufacturer had agreed to make a test to determine exactly how much tolerance can be allowed. Mr. Horstkotte said that, if the District gets a line that is not precisely within the requirements of the specifications but is within the manufacturer's specifications, he did not see where the District would be hurt at all. Mr. Nejedly said the District has ;no authority to waive the specifications. In reply to Member Salfingere's question regarding bedding, Dr. Caldwell said improper support of the pipe is improper bedding and that some of the instal- lation had been made without the proper degree of control by the inspector; he felt the pipe bedding was not compacted prop~rly. Member Roemer asked if the contractor would re-lay the pipe at his expense. Dr. Caldwell replied that the question had not been decided, he did not know whose fault it was, and the re-laying would help determine that. ~ The Board Members discussed progress payment.. Mr. Nejedly said he would advise the District not to make any further payments to the cQntractor until it was made clear that there was no defective work to date. . Mr. Horstkotte stated that all were convinced that the job was being done in accordance with the specifications. that three weeks went by before,settlement showed, and there has been no deficiency for a month and a half. Member Mitchell said nò progress payment should be made until the line is OK. . Member Salfingere asked what type of borings had been made. Dr. Caldwell explaine~and stated every joint would be tested individually. 101658 32 President Fisher asked Dr. Caldwell what really was the feeling of Dames & Moore. Dr. Caldwell replied that it was the fault of the bedding and that the inspec- tion control had been somewhat inadequate. He stated the larger the amount of imported material that you put back in, the more chance there is for settlement of the land; also compaction of new material will result in a heavier load than originally carried. President Fisher asked Dr. Caldwell if he would advise getting another soils engineer. Dr. Caldwell said "No"--he didn't think it was that se rious. ,--,-, Mr. Horstkotte asked if he was correct that, with the exception of the four sections under the County road, there has been no further settlement. President Fisher asked if the line had to be re-layed and because our bedding design was incorrect, would thetotal line then be re-layed at the District's cost.. Dr. Caldwell said the answer was "Yes". President fisher asked if there was any reason for the job to be stopped until we know what we are doing. Dr. Caldwell said "No". Mr. Nejedly said the contractor will not guarantee the line, as long as he did his work in accordance with the plans and specifications. Member Salfingere asked if the inspector knew the specifications were not being followed. Dr. Caldwell said the contractor knew the backfill was not put in"according to specifications; that he was not informed in writing but.was told. President Fisher asked that a report be sent to the Board prior to each meeting until; the situation is straightened 'out, and Mr. Horstkotte and M,r. Nejedly should determine what policy should be followed regarding withholding payments from the contractor from now on. ~.J Member Mitchell asked that the report include a statement enumerating the number of joints over the allowance of the specifications. Bill Thomason, of M.G.M. Construction Co., presented a copy of a report of their soils engineers, Woodward, Clyde, Sherard & Associates. Mr. Thomason explained the various ways in which they attempted to bed the pipe. He said it is a matter of the soil varying in density and major problems occurred in areas where the soil was compressible which they think is why the pipe has settled; it could be a combination of backfill and density of soil. Brown and Caldwell were asked to present a progrees report at the next meeting. VI. NEW BUSINESS. ACCEPTANCE OF EASEMENTS It was moved by Member Salfingere, seconded by Member Roemer, that easements from L. H. MèPherson, Mildred L. Giudice, the Roman Catholic Ardb~ishop of San Prancisco, .and the Roman Catholic Welfare Corporation of San Francisco be accepted and their recording ordered. AUTHORIZATION FOR RENTAL OF C<WPRBSSOR AT mEATMBNT PLANT Mr. Horstkotte requested authorization of $2,500.00 from Sewer Construction Bond Funds for the rental òf a compressor at the Treatment Plant. It was moved by Member Roemer, seconded by Member Salfingere, that $2,500.00 be authorized from Sewer Construction Bond Funds for rental of a compressor at the Treatment Plant. It was moved by Member Roemer, seconded by Member Mitchell, that $713.00 plus tax be authorized from Sewer Construction General Fundi for three Sets of limit switches and Barrow clutches for the sedimentation tanks. Carried by the following vote: AYES: Members: Mitchell, Roemer ,Salfingere and Fisher NOES: Members: None ABSENT: Member: Spiegl VACATION TIME PAID IN LIBJ OF TAKING VACATIC»l Mr. Horstkotte reported that, due to illness in the family of Thomas Bristol, he has asked to be paid for his vacation time in lieu of taking it. 1 , J It was moved by Member Roemer, seconded by Member :Salfingere, :that Thomas Bristol be paid for his vacation time in lieu of taking it. COONSEL FOR mE DIS 'l1tICl' DIS'l1tICl' RESPONSIBILITY Mr. Nejedly, Counsel for the District, stated he did not feel it was the District's responsibility to pay for work to be done twice. It was suggested that Mr. Horstkotte and Mr. Nejedly arrive at a decision together. VIII.
