MBMBBItS FISBBR AND MITaÛ!LL I Members Pisber and Mitchell executed their Oaths of Office for the District's records. ~ ALTNDJNT SLIDB Mr. Horstkotte,District N..ager-Bagineer, reported that he had received esti..tes froa three contractors for the cost of the work to restore the Alt88OUnt slide area and the estiaates were considerably higher than the estiaate given by Porter, Urqalaart, McCreary. O'Brien. Mr. Horsttotte stated that a re-study and lIOdificatioR was beiDl .ade to bring the cost dOWD. He estimated tlae aodification would bring the cost to approxiaately $20,000.00. 'Mr. Nejedly, Counsel for the District, stated that there was no legal basis for the District to advance funds and provide for deferred payaent by tlae present 'residents for their share of the work. Be said vacant properties can be provided for on a connection fee basis. . 09 18 '58 22 After di8cus.ion, it was moved by Member Mitchell, seconded by Member Salfingere that the District Board ha. found that an emergency exists and that the District Manager-Bngineerbeauthorized to negotiate for bids to be received on September 25,1958, at 8,00 o'clock P.M.; Coul18el for the District to prepare an agreement for the prope rty owners. Carried by the following vote: AYBSs Members, Mitchell, Roemer, Salfiagere and Spiegl NOES, Melllber: Fisher ABSENTs Members: None President Fisher explained to the property owner~ present that it would be necessary for them to guarantee, at the Septe8ber 25,1958,: meeting, the payaent of their $8,000.00 share of the cost of the work to be paid prior to completion of the work. Mr. Nejedly, Counsel for the District, will prepare an agreement which they shall enter into. ~ BLINUNBBRG CLAIM Correspondence relative to the Blinkenberg clai. was read. Colonel Blinkenberg stated that District eaployees had trespassed upon his property and had cut branches on a fallen oak tree; he claimed $500.00 damages. After discussion, Member Roemer stated that he felt there was DO substantial d..age done to the tree and, although the employees of the District ..y not have taken the proper legal action to enter upon the property, he IIOved that the clai. be denied, seconded by Meaber Salfingere. Carried by the following vote: AYES: Meabers: Mitchell, Roemer, SaIfingere, Spiegl aDd Pisher NOES, Me.bers: None ABSENT: Members, None VI . NEW BUSINESS AOCBPTANCE OP EASEMENTS It ..s moved by Member Mitchell, seconded by Member Spiegl, that easements from Walter S. Leland and Blaine B. Johnson be accepted and their recordiag ordered. AU'11IORIZING CCfiDEMNATIœ OF GOODJlJNDSŒ PARCEL 15. LOCAL IMPROVEMBNTDISmICT NO. 24 . It was moved by Member Spiegl, seconded by Meaber Salfiagere, that Resolution No. 1139 be adopted. REPORTS DISTRICT MANAGBR-BNGINEBR STATUS OP SLIDE REPAIRS Mr. Horstkotte, Di8trict Manager-Engineer, reported that ,thirteen of the seventeen slides were repaired. ~ STA'lUS OP '11tEATMBNT PLANT ENLARGEMENT AND WTPAU.
