SANITARY DIS1RICT HELD DECIMBER 15, 1955 ,...., The District Board of Central Contra Costa Sanitary District convened in an Adjou med Regular Session at its regular place of meeting located at 1822 Mt. Diablo Eoulev8.rd, City of ~va.1nut Creek, County of Contra Costa, State of California, on December 15, 1955, at 8:00 o'clock P.M. The m~eting was called to order by PresidEnt Roemer. T. ROLL CALL PRESENT: Member s : Mitchell, Fisher, Spiegl; Salfingere and Roemer ABSENT: Members: None II. APPROVAL OF MINUTES The Minutes of the meeting of December 1, 1955, were approved as presented. III. APIROVAL OF BIILS It was moved by Member Mitchell, seconded by Member Fisher, that the bills as audited by the Auditing Committee nnd as sutmitted by the District Manager be approved, reference being specifically made to Sewer Construction Vouchers Numbers 616 to 629, inclusive, and Running Expense Vouchers Numbers 10, 926 to 10,948, inc~usive. OLD BUSINESS Pro roSED OF FlCE SITE REQUES T OF Sm. INGBROOK ROAD PROPER'IY ~NERS RELATIVE '10 LOCATION OF OFF ICE BUILDING ON SITE . , Letter from.Mr. W. Stone representing Soringbrook Road property owners, relative to location of buiiding on property, presented. Mr. Horstkotte, District Manager, explained the plot plan to be presented to the County Planning Conunission and di scussed the building location. Mr. Horstkotte was instructed to reply to Mr. Stone's letter. CRFST AVENUE SEWERS Mr. Horst1cotte, .District Manager, explained that,the County Health Department wanted the original Crest Avenue area sewered without exclusions. Mr. Horst1cotte' was instructed to obtain the Health Officer's Certificate of Necessity for the a.rea they recommend be sewered. VI. REroRTS DI sm ICT MANAGER STA'IUS OF CDNS1RUCTION, LOCAL IMPROVPl-ŒNT DIsmICT NO. 30 Mr. Horstkotte, District Manager, reported that sewage was now flowing in the Local Improvement District No. 30 line and the final tests showed that infi! tration was well wi thin the allo~ce. 12 15 55 l68 VIS~ GRANDE SUBDIVISION CONNECTION Mr. Horstkotte reported that Vista Grande Subdivision had made arrange- ments with Encon Corporation for connection to the Local Improvement District No. 30 line, but that he would not allow Encon to do any outside work with the crews working on Local Improvement District No. 30 until such time as it has been accepted. After discussion, it was moved by Member Spiegl, seconded by Member Salfingere, that, in order to protect Vista Grande Subdivision under a prior agreemen t whereby connection fees would not be due if connected to the District system prior to acceptance of the line by the District and a delay in connecting having been caused by the Dis trict, an extension of time will be granted if acceptance of the line 'occurs prior to january 19,1956, and Vista Grande Subdivision is not yet connected. Lower Orinda Pumping Station. He also reported that after a heavy rain" Eas.t Bay Municipal Utility District had called and asked why they were not notified of overflow and they had been informed that there had been no overflow as the new pumps were in operation. ADDITIONAL AU1HŒIZATIOO FR(J.i SEWER COOSTRUCTION FUNDS FOR INFILTRATION INVEST! GATION Mr. Horstkotte requested an addi tional $400.00 over the $2,000.00 previously authorized to uncover lines in connection with the Brown and Caldwell engineering study. It was moved by Member Salfingere, seconded by Member Spieg1, that $400.00 be authorized from Sewer Construction funds to uncover certain sewer lines in connection wi th the Brown and Caldwell engi Deering study. Carried by the following vote: ~ AYES: NOES: ABSENT: Members: Members: Members: Mitchell, Fisher, Spiegl, Salfingere and Roemer None None METHOD OF REBATE ù'NDER RESOLUTION NO. 877. lOCAL IMmoVEMENT DIS1RICT NO. 30 Mr. Horstkotte suggested that a determination should be made as to how the rebate section of Resolution No. 877 regarding Local Improvement District No. 30 should be handled, setting dates, terms, etc. Member Spiegl stated it should be spelled out in an Ordinance. Mr. Horstkotte and Mr. Nejedly suggested a period of five years from date of confirmation of the assessment. Member Mitchell stated that after five years the funds should be held for the benefit of Local Improvement District No. 30. For clarification, Mr. Horstkotte stated that the assessments for Ii and I! units in Local Improvement District No. 30 were for the original parcels assessed; thereafter property break-ups would be charged, in addition to the normal connection charge, an amount equal to an assessment that would håve been charged if the parcel to Which service is provided had been a parcel at the time of fiHng the Local Improvement District No. 30 assessment as described by Resolution No. 877. The Board Members concurred. -... COUNSEL FOR THE DIS1RICT LOCAL IMPROVH-1ENT DISTRICT NO. 30 LITIGATION Mr. Nejedly, Counsel for the Distri..ct, reported that the Local Improvement District No. 30 suit had been dismissed. 12 15 55 16f Member Spiegl stated that the District should be grateful for the excellent work performed by Mr. Nejedly in this litigation and the Board Members agreed he should be commended for the manner in which the suit was handled. COUN'IY ENCRO ACHMENT ORDI NANCE Mr. Nejedly reported he had discussed the new County encroachment Ordinance with County officials and that it was to be amended and the principal objections were to be eliminated. ..----... AMEND! NG ORDINANCB 22 Mr. Nejedly suggested that consideration should be given to amending Ordinance 22 so that there would be no exclusions from the payment of fees. Member Spiegl stated he would be in fàvor of amending the Ordinance if enough time w>uld be given of the notice of change. Mr. Horstkotte, District Manager, was instructed to endeavór to d~tërmine tile number of homes not connected in the Improvement Districts involved for the next meeting. VII . NEW roSINESS PROTEST OF W. E. SMI1HH'l REGARDING PAYMENT OF CONNECTTON FEES Mr. W. E. Smithen, of Lafayette, protested the payment of the connection fee under Ordinance 22 due to the cost of the main line extension and manhole he had to install. After discussion, it was moved by Member Salfingere, seconded by Member Spiegl., that Mr. Smi then t s protest be denied. HABERLA~D It was moved by Member Fisher, seconded by Member Salfingere, that the President and Secretary be authorized to execute the Quit Claim Deed to Mr. H. W. Haberland for easement in Local Improvement District No. 29, Parcel 14 R-l. Mr. Horstkotte was directed to handle the matter as he may determine. REQUEST FRCM ORINm UNION SCHOOL DISTRICT FOR ANNEXATION OF WAGNER RANCH, ORINDA Mr. Hors tko tte, Dist rict Manage r, was direc ted to inf orm the Orinda Union School District that sewer service will be available to them upon request. REQUEST OF MC GUIRE AND HEStER FOR EX1ENSION OF TIME FOR LOCAL IMffiOVfMfNT DISTRICT NO. 32 It was moved by Member Fisher, seconded by Member Sal fingere, that the request of McGuire and Hester for an extension of time for Local Improvement District No. 32 be denied and that McGuire and Hester be required to pay additional inspection charges from December 14, 1955, to tL~e of completion. Spiegl, Salf ingere and Roemer None None PETERSON CLAIM FOR DAMAGES Mr. Langer. attorney for Mr. Willi_Me Peterson of Glen Road, Lafayette, filed a claim for damages due to clogged sewer line.
