HomeMy WebLinkAboutBOARD MINUTES 07-19-56 ~ MINUTES OF AN ADJOURNED REGULAR MEETING OF THE DISTRICT BOARD CENTRAL CONTRA COSTA SANITARY DISTRICT HELD JULY 19,1956 The District Board of Central Contra Costa Sanitary District convened in an Adjourned Regular Session at its regular place of meeting located at 1822 Mt. Diablo Boulevard, City of Walnut Creek, County of Contra Costa, state of California, on July 19,1956, at 8:00 o'clock P.M. The meeting was called to order by President Roemer. I. ROLL CALL PRESENT: Members: Mitchell, Salfingere and Roemer ABSENT: Members: Fisher and Spiegl II. APPROVAL OF MINUTES The Minutes of the Meeting of July 5,1956, were approved as presented. III. APPROVAL OF BILLS It was moved by Member Mitchell, seconded by Member Salfingere, that the bills as audited by the Auditing Committee and as submitted by the District Manager be approved, reference being specifically made to Sewer Construction Vouchers Numbers 761 to' 770, inclusive, and Running Expense Vouchers Numbers 11,919 to 11,933, inclusive. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Member s: Mitchell, Salfingere and Roemer None Fisher and Spiegl IV. HEARINGS None. OPENING OF BIDS, LOCAL IMPROVEMENT DISTRICT NO. 34 President Roemer called for the opening of bids for Local Improvement District No. 34, which were as follows: Prodanovich, Inc. McGuire and Hester $114,086.00 170,999.00 It was moved by Member Mitchell, seconded by Member Salfingere, that, because of the high bid, the award of contract be held in abeyance until July 26,1956, and the property owners be notified in order to allow them an opportunity to express their desires in the matter. OLD BUSINESS BISHOP RANCH Letter to Olney's Real Estate~ ,prepared by Mr. Nejed1y, Counsel for the District, relative to annexing the Bishop Ranch, was approved. .... REPORTS DISTRICT MANAGER BOND ELECTION Mr. Horstkotte, District Manager, reported on the work being done for the Bond Election and requested that the District Board make a statement for the press relative to the Bond Issue at the next meeting. PAYMENT OF EL NlDO RESTAURANT CLAIM Mr. Horstkotte requested authority to pay claim of $39.08 from the El Nido Restaurant for sewer stoppage caused in relocating sewers because of freeway; the amount ultimately to be repaid by the State Division of Highways. '-' It was moved by Member Salfingere, seconded by Member Mitchell, that the claim from the E1 Nido Restaurant in the sum of $39.08 be paid from Sewer Construction General Funds. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Members: Mitchell, Salfingere and Roemer None Fisher and Spiegl COUNSEL FOR THE DISTRICT S.ETT~1ENT OF REEVES LITIGATION Mr. Gordon, representing Mr. Nejedly, Counsel for the District, reported on the settlement of the Reeves vs. Central Contra Costa Sanitary District and McGuire ,and Hester suit which was declared non suit against Central Contra Costa Sanitary District. CARROLL CLAIM Mr. Gordon stated that a representative of the District Board should appear in the Small Claims Court on July 25, 1956, relative to the claim of Carroll vs. Central Contra Costa Sanitary District and Encon Corporation. vn NEW BUSINESS RESOLUTION NO. 966, APPOINTMENT OF HARRY B. JOHNSON. SEWER INSPECTOR It was moved by Member Salfingere, seconded by Member Mitchell, that Resolution No. 966 be adopted. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Members: Mitchell, Salfingere and Roemer None Fisher and Spieg1 MR. EUGENE A. SHURTLEFF RE AVAILABILITY OF SEWER, LOCAL IMPROVEMENT DISTRICT NO. 34 Letter from Mr. Shurtleff was read. Mr. Shurtleff explained the difficulty in obtaining sewer service as the lines are laid out and requested that the line in Miner Road be extended to provide more adequate service to his home. After discussion, it was moved by Member Mitchell, seconded by Member Salfingere, that Mr. Horstkotte, Engineer for Local Improvement District No. 34, be authorized to extend the line in Miner Road to the extent that no additional manholes will be necessary.' DOZIER RE LOCAL IMPROVPMENr DISTRICT NO. 30 ASSESSMENT Letters from Gaetan M. Zucco and John D. Dozier, asking for relief from assessments levied, were presented. After discussion, it was moved by Member Sa1fingere, seconded by Member Mitchell, that the requests of Gaetan M. Zucco and John D. Dozier for relief from assessments levied in Local Improvement District No. 30 be denied. Carried by the following vote: AYES: NOES: ABSENr: Members: Members: Members: Mitchell, Sa1fingere and Roemer None Fisher and Spieg1 PROGRESS PAYMENTS TO JOHN H. MC COSKER, INC. ON 1955 FLOOD DAMAGE RECONSTRUCTION II AND IV Mr. Horstkotte, District Manager, informed the Board that progress payments to John ,H. McCosker, Inc. for the following cost plus jobs are being made: 1955 Flood Damage Reconstruction II, $2,552.99 1955 Flood Damage Reconstruction IV, $5,521.07 SACRAMENTO NORTHERN RAILWAYEASFMENT RELATIVE TO ACORN COURT RELOCATION Mr. Horstkotte, District Manager, reported the difficulty in obtaining permission to install sewer in the Sacramento Northern Railway right of way. The Board agreed to condemnation for the installation. VIII.
