HomeMy WebLinkAboutBOARD MINUTES 01-13-55 48 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE DISTRICT BOARD CENTRAL CONTRA COSTA SANITARY DISTRICT HELD JANUARY 13, 1955 The District Board of Central Contra Costa Sanitary District convened in an Adjourned Regular session at its regular place of meeting located at 1822 Mt. Diablo Boulevard, City of Walnut Creek, County of Contra Costa, State of California, on January 13,1955, at 8:00 o'clock P.M. '- > The meeting was called to order by President Roemer. I. ROLL CALL PRESENT: Members: Mitchell, FiSher, Spiegl, Salfingere and Roemer ABSENT: Memb er s : None II. APPROVAL OF MINUTES The Minutes of the meeting of January 6,1955, were approved as presented. III. APPROVAL OF BILLS None. IV. HEARINGS LOCAL IMPROVEMENT DISTRICT NO. 31, RESOLUTION OF INTENTION NO. 864 President Roemer opened the hearing with a statement relative to the emergency nature of the work and explained that in levying assessments for work done in Local Improvement District Proceedings, it is the policy of the District Board to assess parcels of land only in those cases in which the facilities constructed through the' proceedings can be employed for the provision of sewer service to that parcel. Where facilities constructed cannot be utilized to provide such service, the cost thereof is not assessed upon such a parcel. ""------ In the proposed work on Moraga Blvd., 'the following properties cannot employ the facilities to be constructed. Moraga Knolls: Parcels 3,4,5,6, 7,8,9,10, 11, 12,13 and Ammen Moraga Woodlands: Parcels 59, 73, 74, 75, 76,77, 78, 79 and portion of 52 Protest of Irving H. Pearce Read Mr. Horstkotte, Engineer, stated that future service from proposed installation would be utilized. It was moved by Member Fisher, seconded by Member Spiegl, that the protest be denied. Culver Read Mr. Horstkotte, Engineer, explained that service was available from other than the proposed installation and the property was not subject to assessment for this work. , It was moved by Member Fisher, seconded by Member Mitchell, that the protest be denied. Booth, Janet A. Yage~, Paul V. Ammen, Lots 3, 4,6 and 7; John Albert Anderson and Mary Lorraine Anderson, Lot 5; Ray A. Taber, Lot 8; Byron N. Priest and Edith F. Priest, Lot 9; Janet A. Yager, Lots 10 and 11; Sally A. Booth, Lot 12; Franklyn M. Silva and Mildred A. Silva, Lot 13; all designated lots in Moraga Knolls; and Paul V. Ammen and Carroll E. Ammen, approximately seven acres in the vicinity of Moraga Knolls. It was determined by Mr. Horstkotte, Engineer, that these properties would receive no service from the proposed work. It was moved by Member SpiegÌ, seconded by Member Fisher, that the protests be denied. Carried by the following vote: AYES: Members: Mitchell, Fisher, Spiegl, Salfingere and Roetner None None --... ! NOES: ABSENT: Members: Members: and Alfred Mr. Forsburg and Mr. Merritt agreed to the proposed work but ~rotest~d more than one unit of assessment on their properties. Member ~pieg suggested tabling the protests. It was moved by Member Fisher, seconded by Member Mitchell~ that the protest be denied. Jackson, Lot 14, Moraga Woodl~ Mr. Jackson asked if his proper~ was included within the area to be assessed. The Engineer stated it was. No protest. Protest of Jack E. Bernhard, Portions of Lots 69 and 70, Moraga Woodlands Mr. Bernhard protested the inclusion of his property. It was moved by Member Spiegl, seconded by Membe~ Fisher, that the protest be denied. Taranto, Lots 70 and 74, Moraga Woodlands Mr. Taranto asked if Lots 70 and 74 of Moraga Woodlands were to be served by the proposed line and assessed. No protest on Lot 74 when he was informed there would be no service from the proposed line. He protested the inclusion and assessment of Lot 70 because he doubted gravity service could be obtained. It was 'moved by Member Fisher, seconded by Member Mitchell, that the protest be denied. Carried by the following vote: AYES: Members: Mitchell, Fisher, Spiegl, Salfingere and Roemer None None \_' NOES: ABSENT: Members: Members: Charles H. Biesel, Lot 56, Moraga Woodlands 'Mr. Biesel did not protest after being informed that his property was not excluded and shown the manner in which it would be served. Protest of Fred Brown. Withdrawn 'Mr. Brown, protesting the location of a certain manhole, withdrew his protest after receiving an explanation from the Engineer. Protest of Joseph L. Dirickx, Lot 67, Moraga Woodlands Mr. Dirickx protested inclusion. It was moved by Member Fisher, seconded by Member Mitchell, that the protest be denied. Carried by the following vote: AYES: NOES: ABSENT: Members: Mitchell, Fisher, Spiegl, Salfingere and Roemer None None Members: Members: Gilbert Earle, Portion of Lot 59, Moraga Woodlands Mr. Earle, when informed that his property was not to be served by the proposed work did not protest. ""- .' Protest of Harrold Bowers, Portion of Lot 24, Moraga Woodlands Mr. Bowers protested inclusion. If included, he stated that certain lots. particularly Lot 9 in Moraga Knolls, should be included. After explanation from the Engineer, it was moved by Member Fisher, seconded by Member Sa1fingere, that the protest be denied. Carried by the following vote: AYES: Members: Mitchell, FiSher, Spiegl, Salfingere and Roemer None None NOES: ABSENT : Members: Members: There being no further protests, President Roemer declared the hearing of protests would be terminated and the hearing on Local Improvement District No. 31 would be continued to the meeting_.of January 20,1955. He instructed Mr. Nejedly, Counsel for the District, to prepare, for that meeting, the. Resolutions necessary to proceed. '--"' v. OLD BUSINESS DIABLO PUBLIC UTILITY DISTRICT Dr. Blum, County Health Officer, stated that Diablo Public Utility District has a problem and now have an alternate to fixing . !>: 01 13 55 f'l i) their own sewer system. Sanitary District. President Roemer replied that a survey had been made of the Diablo Public Utility District system and terms for annexing to the Sanitary District had been presented to them. Dr. Blum asked what could be done by the r, Mr. Wendt, of Diablo Public Utility District, asked for a súmm.ary of the terms, which Mr. Horstkotte reviewed from the correspondence on file, explaining further that the terms were the same as to others in the area, and that, in certain cases, District charges were waived in lieu of funds expended in installing over- sized lines. Mr. Wendt asked for a meeting between their Engineer, Mr. Yoder, and Mr. Horstkotte to determine what portion of their system might be accepted by the Sanitary District. Mr. Nejedly, Counsel for the District, was instructed to prepare a letter to Diablo Public Utility District, setting forth a deferred payment plan for annexation fees under Ordinance No. 24, and an analysis of their present costs in relation to what the' estimated cost of annexing to the Sanitary District would be. Mr. Nejedly asked about the number.of connections to the system and was informed that there were 71, the Diablo Country Club load accounting for approximately 33%. ' VI. REPOR TS DISTRICT MANAGER LETTER TO COUNTY AGENCIES RELATIVE TO DANVILLE PROBLEM IN GETTING A LINE OF SUFFICIENT SIZE . .. Mr. Horstkotte, District Manager, suggested to the District Board that the Board of Supervisors, County Administrator, Dr. Blum, Health Officer, Contra Costa County Taxpayers Association, Planning Commission, and Mr. O'Connell, Engineering Consultant for Contra Costa County, be notified of the Danville problem in getting a line of sufficient capacity to be more economical to all concerned. Dr. Blum thought this was a good suggestion and offered his cooperation. Mr. Nejedly, Counsel for the District, stated that, as a last resort, the Board of Supervisors could authorize the creation of a Local Improvement District outside the Sanitary'District for this purpose. The District Board determined that whatever possible should be done. VII. NEW BUSINESS BROWN AND CALDWELL PROPOSAL Letter of proposal from Brown and Caldwell for a comprehensive survey was read. Member Spiegl stated that some of what was proposed he had expected to get in the present contract. Member Mitchell stated that some of the proposed work would be done under the present contract and questioned whether there would be a duplication of cost to the District. ACCEPTANCE OF EASEMENT, GEORGE HARTZELL It was moved by Member Spiegl, seconded by Member Sal£ingere, that the easement £rom George Hartzell be accepted and recording ordered. Carried by the £ollowing vote: AYES: NOES: ABSENT: Members: Mitchell, Fisher, Spiegl, Sal£ingere and Roemer None None Members: Members: SOUTHERN ANNEXATION I REQUEST FOR ASSISTANCE IN OBTAINING CONNECTIONS Letter £rom Southern Annexation I group was presented, in whiCh they requested help in obtaining 350 connections along with their 650 connections so as to be able to start a Local Improvement District. Mr. Nejedly, Counsel £or the District, was instructed to prepare a letter to the Southern Annexation I group, to be approved by the District Board at its next meeting, settin~ up a plan for de£erred payment under Ordinance No. 24 £or the 350 connections required. .
