HomeMy WebLinkAboutBOARD MINUTES 12-02-54 32 MINUTES OF A REGULAR MEETING OF THE DISTRICT BOARD CENTRAL CONTRA COSTA SANITARY DISTRICT HELD DECEMBER 2,1954 The District Board of Central Contra Costa Sanitary District convened in a Regular session at its regular place of m88tinslocated at 1822 Mt. Diablo Boulevard, City'of Walnut Creek, County of Contra Costa, State of California, on December 2, 1954, at 8:00 o'clock, P.M. The meeting was called to order by President Roemer. '"--, I. ROLL CALL PRESENT: Members: Mitchell, Fisher, Spiegl, Salfingere and Roemer ABSENT: Members: None II. APPROVAL OF MINUTES The Minutes of the meeting of November 18,1954 were approved as presented. III. APPROVAL OF BILLS It was moved by Member Mitohell, seconded by Member Salfingere, that the bills as audited by the Auditing Committee and as sdbmitted by the District Manager be approved, reference being specifically made to Sewer Construction Vouchers Numbers 333 to 336, inclusive, and Running Expense Vouchers Numbers 9238 to 9356, inclusive. Carried by the following vote: . AYES: Members: Mitchell, Fisher, Spiegl, Salfingere and Róemer NOES: Members: None ~ ABSENT: Members: None IV. HEARINGS LOCAL IMPROVEMENT DISTRICT NO. 29, RESOLUTION OF INTENTION ,NO. 854 President Roemer asked for written protests. PROTEST OF MR. LYNCH READ Mr. Lynch also expressed his concern as to his property being properly served due to a creek culvert not at proper grade as well as the sewer installation aggravating a presently bad situation~ ... Mr. Lynch expressed his desire for sewers, stating that the proper servicing of his property and the approval of the Flóod Control District as to the creek crossing were his only objections. The Flood Control District's authority and necessary approval were questioned. Member MitcheIl stated he believed their authority was established in County Ordinance No. 792. Mr. Nejedly, Counsel for the District, stated that the Board ot Supervisors was the authority, whose approval the District had obtained. Mr. Lynch thanked Mr. Horstkotte, District Manager, for his cooperation and expressed his opinion as to its being a difficult engineering problem. Mr. Horstkotte, District Manager, stated that the property can be served and explained the manner of service. '~ 12 02 " 54 -~ I ~ , I 3.3 Continued to next meeting. PROTEST OF DR. NICOLSON, REPRESENTED BY ATTORNEY EDMUND BARNETT. READ Mr. Horstkotte, District Manager, explained the need for the easement at the particular locati~n on Dr. Nicolson's property. Mr. Barnett stated that Dr. Nicolson was not interested in having property sewered and that it would force Dr. Nicolson to develop the property. Mr. Barnett stated that, if developed, the property could not be properly served at the present location of the easement. . . After discussion, it was moved by Member Salfingere, seconded by Member Mitchell, that the protest be denied. Mr. J. L. Cooley stated he had three questions: 1. When will the property owners learn of their assessments? . Mr.' Horstkotte, District Manager, explained the procedure and the schedule for the work. 2. Questioned his signing an exclusive easement when another easement exists in the same area. Mr. Nejedly, Counsel for the District, explained. 3. What would be the unit cost of connecting? Mr. Horstkotte, District Manager, explained the cost is on a fixture basis under Ordinance No. 22. Mr. Savage asked about and was shown sewer locations on Castle Hill Ran~ Road. Mr. Hubach brought to the attention of the Board the matter of contractors being generally slow and lax in getting. streets back into shape, and as~ed th~t the District give this matter its attention. Mr. Southworth asked for the elevation of the sewers on Montecillo Drive. Mr. Horstkótte, District Manager, showed and explained the elevation to Mr. Southworth's satisfaction. Hr. Parker asked for what would be considered as a rough estimate of the unit of assessment for the area. Mr. Horstkotte, District"Mànàger;, estimated the assessment would be, roughly, about $520.00 per unit. It was moved by Member Spiegl, seconded by Member Fisher, that the public hearing be closed and that the unfinished matters be continued to the meeting of December 16, 1954. OLD BUS!NESS PROPOSED ORDINANCE FOR REBATING FUNDS COLLECTED FOR EXCESS CAPACITY LINES Continued to next, meeting. VI. REPORTS , DISTRICT MANAGER Mr. Horstkotte, District Manager, submitted a work schedule for the engineering required of the office staff. Mr. Horstkotte requested that a Civil Service classiflc'ation for Draftsman be' established. - ,- ---- RESOLUTION NO. 858, CIVIL SERVICE CLASSIFICATION FOR DRAFTSMAN It was moved by Member Salflngere, seconded by Member Fisher, "that Resolution No., 858 be adopted. Carried by the following vote: AYES: Member!)l : Mitchell, Fisher, Spiegl, Salfingere and Boemer None None NOES: ABSENT : Members: Members: Resolütion No. 858 on file in the office of the Secretary is hereby referred to and by reference made a part hereof. CIVIL SERVICE EXAMINATION FOR DRAFTSMAN CLASSIFICATION It was moved by Member Salfingere, seconded by Membar Spiegl, that a Civil Service examination be held for the classification of Drafts~an. Carried by the fòllowing vote: AYES: Members: Mitchell, Fisher, Spiegl, Sal£ingere and Roemer None None ~ ,NOES: ABSENT: Members: Members: SEWER RELOCATION, MT. DIABLO BLVD. AND PLEASANT HILL ROAD AREA - Mr. Horstkotte, District Manager, stated that plans for sewer relocation required by the State Highway DepartMent in the .area of Rick's Drive-In at Mt. Diablo Blvd. and Pleasant Hill Road would be submitted- at the next meeting. COUNSEL FOR THE DISTRICT LONG EASEMENT, ORINDA Mr. Nejedly, Còunsel for the District, reported that negotiations are still in progress towards settlement of the condemnation of the Long easement in Orinda. VII. ow BUSINESS MQUEST OF DR. BLUM,' COUNTY HEALTH OFFICER, FOR SEWERING ENTIRE WATERSHED AREA ¡ I ~ Dr. Blum asked for serious consideration and commitment ot the District Board to take care of the entire watershed area, stating that areas ~utside of the present District boundariea presented a consideraþle Health Department problem.' 12 02 54 B5 The Health Department requires larger lots than would ordinarily be necessary when septic tanks are used, making it more expensive when areas are sewered at a later date. ...--"" Dr. Blum stated that it is not economical to install septic tanks in areas within the District needing sewers, and that his office had no objection to going on record regarding the areas needing sewers. He requested that the Board institute proceedings on the "Health Officer's Certificate of Necessity" in these cases. Mr. Nejedly, Counsel for the District, explained the require- ments of the law under the "Improvement Act of 1911" and the practical aspects. Dr. Blum requested consideration by the District Board when notified by the Health Department of unhealthy areas. REQUEST OF ROY W. TESS, ORINDA, FOR INSTALLATION OF SEWERS President Roemer read letter from Mr. Tess requesting that sewers be installed in the Miner-Orinda area due to septic tank failures. Mr. Tess also reviewed the work that had been done in the past to get sewers installed. Dr. Blum stated that the situation should be reevaluated at the present time and this area would be among the :first to be investigated. President Roemer requested that Dr. Blum inform the District after the investigation. DISCUSSION RE POLICIES FOR SEWERING --- I Dr. Blum discussed the problem of sewering lots within the Local Improvement Districts and stated that the investigation of septic tanks and incident pròblems is expensive to the Health Department and the taxpay&rs. He further stated that the Health Department would like to work out an agreement for connecting faulty septic tanks to the sewer system. Mr. Nejedly sugg~sted that an amendment to the "Improvement Act of 1911", on which he was working, would be an effective means of sewering as it would permit the District to sewer and put the cost incurred on the tax bill. Dr. Blum stated that the Health Department can force the correction of nuisances, but cannot sewer; the District can require sewers. The Health Department will investigate faulty septic tanks. They want the nuisance corrected by connection to sewers rather than co~tinued repair of septic tank system. . Dr. Blum asked Mr~.Nejedly to give him 8. copy of the change suggested in the "Improvement Act of 1911" so that he could circulate and get cooperation for its passage. . REQUEST OF COUNTY ROAD COMMISSIONER FOR INSTALLATION OF SEWERS IN MORAGA HIGHWAY Letter from Mr. Sauer, County Road Commissioner, was read. Mr. Sauer requested that sewers be installed on Moraga Highway between Glorietta Boulevard and Valley View Drive prior to highway construction starting in April, 1955. The County Health Department has a letter. on file with the District requesting that sewers be installed In this area. To date, there.has been no action pending receipt of petition which is being circulated. 12 02 54 36 It was moved by Member Spiegl, seconded by Member Salfingere, that the District Manager be authorized to proceed with the engineering for this area, to be known as ."LocalImprovement District No. 31". DISCHARGE OF EFFLUENT "----' Dr. Blum, Gounty He$lth Officer, stated that he had disèussed with the St~te Water Pollution Control Board the request from the District to discharge effluent into Grayson Creek. Mr. Horstkotte, District Manager, explained the problem in relation to the oxidation pond area required and an outfall line to the Bay. Fencing was in the planning. Dr. Blum stated he would seek the counsel of the State Health Department and that fencing was a significant help to the problem. Dr. Blum thanked the District Board for the hearing. President Roemer thanked Dr. Blum. Mr. Roy Tess of Miner Orinda thanked the District Board. CONNECTION FEE PROTEST, PAUL HAMMARBERG Letter from Byers, Burd & Fraser, Attorneys for Paul Hammarberg, protesting connection fees, was read. After discussion, it was moved by Member Fisher, seconded by Member Spiegl, that the protest be denied.
