HomeMy WebLinkAboutBOARD MINUTES 11-13-71 172 MINUTES OF A SPECIAL MEETING OF THE DISTRICT BOARD CENTRAL CONTRA COSTA SANITARY DISTRICT HELD NOVEMBER 13, 1971 The District Board of Central Contra Costa Sanitary District convened in a Special Session at its regular place of meeting located at 1250 Spring- brook Road, Walnut Creek, County of Contra Costa, State of California, on November 13, 1971, at 10:00 o'clock A.M. The meeting was called to order by President Gibbs. I. ROLL CALL PRESENT: Members: Boneysteele, Mitchell and Gibbs ABSENT: Members: Rustigian and Allan II. OLD BUSINESS GARBAGE RATE INCREASES REQUESTED BY VALLEY DISPOSAL SERVICE, INC. AND DIABLO DISPOSAL SERVICE Mr. Horstkotte, General Manager-Chief Engineer, reviewed the action taken by the Board of Directors at the public hearing held on August 19, 1971, to consider rate increases requested by Valley Disposal Service, Inc. and Diablo Disposal Service. Mr. Bohn, Counsel for the District, explained to Members of the Board of Directors, the implications of the President's price freeze program and the Phase II program as interpreted by Counsel from information available. After general discussion by Members of the Board, Mr. Horstkotte, Mr. Bohn and members of the staff, it was moved by Member Mitchell, seconded by Member Boneysteele, that Ordinance 83, as hereinafter set forth, granting a rate increase for Valley Disposal Service, Inc. and Diablo Disposal Service, effective January 1, 1972, be adopted, except where prohibited by price regulations issued under authority of the U. S. Government. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Members: Boneysteele, Mitchell and Gibbs None Rustigian and Allan "ORDINANCE 83 "AN ORDINANCE AMENDING SECTIONS 12-122; 12-123: AND 12-124 OF THE CODE OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT RELATING TO GARBAGE COLLECTION RATES "SECTION 1: Section 12-122 of the Code of the Central Contra Costa Sanitary District is hereby amended to read as follows: "Sec. 12-122. Maximum rates for garbage collections: (1) The rates to be charged in all zones shall be established as follows: (a) single family dwelling units and commercial establishments shall be entitled to one collection each week at a rate fixed for the first container collected; (b) multi-family dwelling units shall be entitled to one collection each week at a rate fixed for each dwelling unit; (c) each additional container collected at the same time on a regular monthly schedule, except for multi-family dwelling units, shall be charged at an additional container fixed rate, except that in Zone 3 (Pleasant Hill-Bay 11 13 71 1/:' Shore Disposal) and in Zone 4 (Valley Disposal), single family dwelling units in addition to the one collection per week, shall be entitled to one garden trimmings collection picked up at the curb each week and three major trash pick ups per year at a fixed rate shown below; (d) each additional collection each week on a regular monthly schedule for multi-family dwelling units shall be charged at a fixed rate shown below; (e) each additional container collected at the same time on a non- regular schedule shall be charged for each pick up at an additional container fixed rate; (f) bulk collections shall be charged for each pick up on the basis of cubic yards and fractions thereof collected. Maximum residential rates where special conditions exist. In each Zone where a special truck is required for collection because of (l) the condition of a roadway, (2) the degree of incline, (3) the condition of a driveway, or (4) the distance of the area where a container is kept from the street, the maximum basic residential rate for one collection a week of 32 gal- lons or less is $3.60 a month, EXCEPT: (1) beginning June l, 1971, for Zone 1 (Orinda-Moraga Disposal) where the maximum rate is $4.60 a month; (2) beginning March 1, 1971, for Zone 2 (Lafayette Disposal) where the maximum rate for 1971 is $4.30, for 1972 is $4.90 and for 1973 is $5.25 a month; (3) beginning January 1, 1972 for Zone 4 (Valley Disposal) and Zone 5 (Diablo Disposal) where the maximum rate is $4.15 a month. "SECTION 3: Section 12-124 of the Code of the Central Contra Costa Sanitary District is hereby amended to read as follows: 'Section l2-l24. Minimum rates for special collections. In each Zone, the minimum rate for each special collection requested by a customer is $3.60, EXCEPT: (l) beginning June 1, 1971 for Zone 1 (.orinda- Moraga Disposal) where the minimum rate is $4.60; (2) beginning March l, 1971 for Zone 2 (Lafayette Disposal) where the minimum rate for 1971 is $4.30, for Ii 13 71 .LI.J 1972 is $4.90, and for 1973 is $5.25; (3) beginning January 1, 1972 for Zone 4 (Valley Disposal) and Zone 5 (Diablo Disposal) where the minimum rate is $4.l5. "SECTION 4: This Ordinance shall be a general regulation of the District and shall be published once in the Contra Costa Times, a newspaper of general circula- tion, published and circulated in Central Contra Costa Sanitary District and shall be effective upon expiration of the week of publication. GENERAL MANAGER-CHIEF ENGINEER Mr. Horstkotte reported on a study session attended by Member Mitchell held on November 9, 1971, with the Members of the Board of Directors and staff of Contra Costa County Water District. A general discussion followed. Mr. Horstkotte stated a joint meeting of the Board of Directors of the Water District and the Sanitary District to hear a final progress report by Bechtel Corporation was scheduled for December 8,1971. After discussion, the date was rescheduled to December 7, 1971. COUNSEL FOR THE DISTRICT Mr. Bohn reported on a meeting held in San Jose concerning BASSA and stated that he was to attend a meeting on November 17, 1971, as District representative. IV.
