HomeMy WebLinkAboutBOARD MINUTES 06-03-71 99 MINUTES OF A REGULAR MEETING OF THE DISTRICT BOARD CENTRAL CONTRA COSTA SANITARY DISTRICT HELD JUNE 3, 1971 The District Board of Central Contra Costa Sanitary District convened in a Regular Session at its regular place of meeting located at 1250 Springbrook Road, Walnut Creek, County of Contra Costa, State of California, on June 3, 1971, at 8:00 o'clock P.M. The meeting was called to order by President Gibbs. 1. ROLL CALL PRESENT: Members: Boneysteele, Rustigian, Mitchell, Allan and Gibbs ABSENT: Members: None II. APPROVAL OF MINUTES The Minutes of the meeting of May 27, 1971, were approved as presented. III. APPROVAL OF EXPENDITURES It was moved by Member Mitchell, seconded by Member Boneysteele, that the expenditures, as reviewed by the Expenditure Committee and as submitted by the General Manager-Chief Engineer, be approved, reference being specifi- cally made to Sewer Construction Vouchers ~umbers 1034 to 1056, inclusive, Running Expense Vouchers Numbers 12795 to 12911, inclusive, Payroll Vouchers Numbers 394 to 493, inclusive, and LID 50 Construction Fund Vouchers Numbers 117, 118 and 119. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Members: Boneysteele, Rustigian, Mitchell, Allan and Gibbs None None Mr. Horstkotte, General Manager-Chief Engineer, submitted a breakdown of expenditures relating to his and Mr. Niles, Superintendent of Plant Opera- tions, recent trip to Europe and South Africa, and stated he had charged hotel accommodations in South Africa to his credit card. IV. HEARINGS ORINDA/MORAGA DISPOSAL SERVICE GARBAGE RATE INCREASE Mr. Horstkotte, General Manager-Chief Engineer, presented copies of a table of comparative rate schedules to the Board Members, which was in ad- dition to the staff's rate study report previously presented. President Gibbs opened the Hearing on Orinda/Moraga Disposal Service garbage rate increase, and acknowledged letters from Mrs. Loyd Fletcher and Mr. Mayer Colber who protested the proposed rate increase. After discussion between Board Members, staff and members of the audience, Mr. Davis, Administrative Assistant, was directed to meet with Mr. Brethauer, Certified Public Accountant, for Orinda/Moraga Disposal Service, regarding franchise costs, interest charges, and depreciation allowances. President Gibbs asked for oral protests. There were none. Mr. Navone, owner of Orinda/Moraga Disposal Service, requested that the Board allow an increase for 1971 at this time. After discussion, Member Allan introduced Ordinance 77. It was moved by Member Mitchell, seconded by Member Boneysteele, that Ordinance 77, as hereinafter set forth, be adopted. Carried by the following vote: 06 03 71 100 AYES: NOES: ABSENT: Members: Members: Members: Boneysteele, Rustigian, Mitchell, Allan and Gibbs None None "ORDINANCE 77 "An Ordinance amending Sections 12-122; 12-123; and 12-124 of the Code of the Central Contra Costa Sanitary District relating to garbage collection rates: "SECTION 1: Section 12-122 of the Code of the Central Contra Costa Sanitary District is hereby amended to read as follows: "Sec. 12-122. Maximum rates for garbage collections: (1) The rates to be charged in all zones shall be established on the basis of the number of containers collected as follows: (a) single family dwelling units, multi-family dwelling units, and commercial establishments shall be entitled to one collection each week at a rate fixed for the first container collected; (b) each additional container collected at the same time on a regular monthly schedule shall be charged at an additional container fixed rate, except that in Zone 3 and in Zone 4 single family dwelling units shall, in addition to the one collection per week, be entitled to one garden trim- mings collection picked up at the curb each week at a fixed rate shown below; (c) each additional container collected at the same time on a non- regular schedule shall be charged for each pick up at an additional container fixed rate; (d) each additional collection each week on a regular monthly schedule for multi-family dwelling units shall be charged at a fixed rate shown below; (e) bulk collections shall be charged for each pick up on the basis of cubic yards and fractions thereof, collected on a regular schedule. Maximum residential rates where special conditions exist. In each zone where a special truck is required for the collection because of (1) the condition of the roadway, (2) the degree of incline, (3) the condition of a driveway, or (4) the distance of the area where a container is kept from the street, the maximum basic residential rate for one collection a week of 32 gallons or less is $3.60 a month, EXCEPT: (1) beginning March 1, 1971, for Zone 2 where the maximum rate for 1971 is $4.30, for 1972 is $4.90 and for 1973 is $5.25 a month, (2) beginning June 1, 1971, for Zone 1 where the maximum rate is $4.60 a month. "SECTION 3: Section 12-124 of the Code of the Central Contra Costa Sanitary District is hereby amended to read as follows: 06 03 71 102 Section 12-124. Minimum rates for special collections. In each Zone, the minimum rate for each special collection requested by a customer is $3.60, except: (1) beginning March 1, 1971, for Zone 2 where the minimum rate for 1971 is $4.30, for 1972 is $4.90 and for 1973 is $5.25, (2) be- ginning June 1, 1971, for Zone 1 where the minimum rate is $4.60. "SECTION 4: This ordinance shall be a general regulation of the District and shall be published once in the Contra Costa Times, a newspaper of general circulation, published and circulated in Central Contra Costa Sanitary District and shall be effective upon expiration of the week of publication. NEW BUSINESS SEWER CONSTRUCTION AUTHORIZATION FOR ELECTRICAL FACILITIES AT BUCHANAN FIELD It was moved by Member Mitchell, seconded by Member Rustigian, that $216.33 for electrical facilities at Buchanan Field be authorized from Sewer Construction funds to close the account. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Members: Boneysteele, Rustigian, Mitchell, Allan and Gibbs None None SEWER CONSTRUCTION AUTHORIZATION FOR DISTRICT SEWERING PROJECT 1977, SUMMIT ROAD It was moved by Member Rustigian, seconded by Member Allan, that $1,400.00 be authorized from Sewer Construction funds 'for District Expense, District Sewering Project 1977, Summit Road. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Members: Boneysteele, Rustigian, Mitchell, Allan and Gibbs None None AUTHORIZATION TO EXECUTE REVOCABLE LICENSE TO THE CITY OF LAFAYETTE FOR THE USE OF THE FORMER SACRAMENTO NORTHERN RAILWAY RIGHT OF WAY FOR TRAIL PURPOSES After an explanation and upon the recommendation of Mr. Bohn, Counsel for the District, it was moved by Member Rustigian, seconded by Member Allan, that the President and Secretary be authorized to execute a Revocable License to the City of Lafayette for the use of the former Sacramento Northern Railway right of way for trail purposes; said Revocable License to be in the same form as that prepared for execution by the East Bay Municipal Utility District. Bruzzone, Inc., Job 1991, Parcell, be accepted and their recording ordered. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Members: Boneysteele, Rustigian, Mitchell, Allan and Gibbs None None RECOMMENDATION TO BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY RE RETIREMENT BENEFITS After an explanation from Mr. Horstkotte, General Manager-Chief Engineer, it was moved by Member Allan, seconded by Member Boneysteele, that a letter over Pre- sident Gibbs' signature be sent to the Board of Supervisors of the Contra Costa County recommending affirmative action on the proposal under consideration which would base the retiree's benefits on his highest year's salary rather than on his highest 36 months average salary now in effect. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Members: Boneysteele, Rustigian, Mitchell, Allan and Gibbs None None "ORDINANCE 78 "BE IT ORDAINED by the Board of Directors of the Central Contra Costa Sanitary District, as follows: "Paragraph (b) of Section ll-142 of the Central Contra Costa Sanitary District Code is hereby amended to read: '(b) The equalization charge is in addition to all other charges and shall be at the then applicable rebate charge rate and for the number of as- sessment units of use which would have formed the basis for assessing the property had it been included in said proceedings, or, if included, then as specified in a special recorded agreement between the District and the property owner or predecessor in interest.' "This Ordinance shall be a general regulation of the District and shall be published once in the Contra Costa Times, a newspaper of general circula- tion, published and circulated in Central Contra Costa Sanitary District and shall be effective upon expiration of the week of publication. OGDEN After Mr. Horstkotte, General Manager-Chief Engineer's, recommendation, it was moved by Member Rustigian, seconded by Member Allan, that the claim of J. A. Ogden in the amount of $15.70 for auto repair be paid following re- ceipt of signed Release in Full Settlement and Compromise. VIII. REPORTS COMMITTEES None. GENERAL MANAGER-CHIEF ENGINEER RESIGNATION OF SUPERVISING CONSTRUCTION INSPECTOR Mr. Horstkotte, General Manager-Chief Engineer, reported that Edwin Foster, Supervising Construction Inspector, had submitted his resignation to be effective in July. He commended Mr. Foster for his excellent employment record during his fifteen years with the District. LEAVE OF ABSENCE Mr. Horstkotte reported that Alvin Gillespie, Engineering Aid III, had re- quested leave of absence for an indefinite time due to disability, not job-con- nected. It was moved by Member Allan, seconded by Member Rustigian, that Alvin Gillespie, Engineering Aid III, be granted a leave of absence for an indefinite time. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Members: Boneysteele, Rustigian, Mitchell, Allan and Gibbs None None USE OF OUTFALL SEWER EASEMENT BY INDUSTRIAL TANK, INC. Mr. Horstkotte, General Manager-Chief Engineer, reported receipt of a re- quest from Industrial Tank, Inc. to be allowed to use a portion of the Outfall Sewer easement. He stated there would be no engineering problem involved in granting the request, but that Mr. Bohn, Counsel for the District, recommended an agreement or permit be entered into granting a revocable right to use the easement for pipeline purposes which is without consideration and can be revoked at any time. It was moved by Member Rustigian, seconded by Member Boneysteele, that the staff be authorized to negotiate an agreement or permit with Industrial Tank, Inc. for the use of a portion of the Outfall Sewer easement granting a revocable right to use the easement for pipeline purposes which is without consideration and can be revoked at any time. At 10:58 o'clock P.M., President Gibbs reconvened the regular meeting. IX.
