MINUTES OF A REGULAR MEETING OF THE DISTRICT BOARD CENTRAL CONTRA COSTA SANITARY DISTRICT HELD APRIL 1, 1971 The District Board of Central Contra Costa Sanitary District convened in a Regular Session at its regular place of meeting located at 1250 Spring- brook Road, Walnut Creek, County of Contra Costa, State of California, on April 1, 1971, at 8:00 o'clock P.M. The meeting was called to order by President Gibbs. I. ROLL CALL PRESENT: Members: Boneysteele, Mitchell, Allan and Gibbs ABSENT: Member: Rustigian Member Rustigian arrived at 8:03 o'clock P.M. II. APPROVAL OF MINUTES The Minutes of the meeting of March 24, 1971, were approved as presented. III. APPROVAL OF EXPENDITURES It was moved by Member Mitchell, seconded by Member Boneysteele, that the expenditures, as reviewed by the Expenditure Committee and as submitted by the General Manager-Chief Engineer, be approved, reference being specifi- cally made to Sewer Construction Vouchers Numbers 995 to 1014, inclusive, Running Expense Vouchers Numbers 12511 to 12642, inclusive, Payroll Vouchers Numbers 197 to 294, inclusive, and LID 50 Construction Fund Voucher Number 113. Carried by the following vote: AYES: Members: Boneysteele, Mitchell, Allan and Gibbs NOES: Members: None ABSENT: Member: Rustigian IV. HEARINGS RATE INCREASE, LAFAYETTE GARBAGE DISPOSAL SERVICE. INC. Mr. Horstkotte, General Manager-Chief Engineer, stated notice of the Hearing had been adequately advertised. President Gibbs opened the Hearing and asked for any protests. There being none, President Gibbs asked Mr. Ernest Marriner, City Manager of Lafayette, who was in the audience, if he wished to address the Board. Mr. Marriner declined and President Gibbs closed the Hearing. President Gibbs asked Member Boneysteele to comment on the requested rate increase. Member Boneysteele explained that over a period of years the District had attempted to establish a fair basis on which to determine whether garbage collection rates should be adjusted, and to that end an accountant had set up an accounting system to be used by all the collectors. He stated that Mr. Davis, Administrative Assistant, had conferred with various people familiar with garbage rates, particularly the rate engineer for the City of San Francisco, and had made a very thorough analysis of rates, costs and revenue of the Lafayette Garbage Disposal Service, Inc., on which analysis the Board's decision will be based. Mr. Horstkotte, General Manager-Chief Engineer, pointed out that the rates resulting from the staff analysis were within fractions of the rates requested by Lafayette Garbage Disposal Service, Inc. 04 01 71 /L After discussion, it was moved by Member Rustigian, seconded by Member Allan, that the rates requested by Lafayette Garbage Disposal Service, Inc. in their proposal be approved effective March 1, 1971, and that Ordinance 74 be adopted. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Members: Boneysteele, Rustigian, Mitchell, Allan and Gibbs None None "ORDINANCE 74 "An Ordinance amending Sections 12-122; 12-123; and 12-124 of the Code of the Central Contra Costa Sanitary District relating to garbage collection rates: "SECTION 1: Section 12-122 of the Code of the Central Contra Costa Sanitary District is hereby amended to read as follows: "Sec. 12-122. Maximum rates for garbage collections: (1) The rates to be charged in all zones shall be established on the basis of the number of containers collected as follows: (a) single family dwelling units, multi-family dwelling units, and commercial establishments shall be entitled to one collection each week at a rate fixed for the first container collected; (b) each additional container collected at the same time on a regular monthly schedule shall be charged at an additional container fixed rate, except that in Zone 3 and in Zone 4 single family dwelling units shall, in addition to the one collection per week, be entitled to one garden trimmings collection picked up at the curb each week at a fixed rate shown below; (c) each additional container collected at the same time on a non- regular schedule shall be charged for each pick up at an additional container fixed rate; (d) each additional collection each week on a regular monthly schedule for multi-family dwelliDgunits shall be charged at a fixed rate shown below; (e) bulk collections shall be charged for each pick up on the basis of cubic yards and fractions thereof, collected on a regular schedule. Maximum residential rates where special conditions exist. In each zone where a special truck is required for the collection because of (1) the condition of a roadway, (2) the degree of incline, (3) the condition of a driveway, or (4) the distance of the area where a container is kept from the street, the maximum basic residential rate for one collection a week of 32 gallons or less is $3.60 a month, except beginning March 1, 1971, for Zone 2 where the maximum rate for 1971 is $4.30, for 1972 is $4.90 and for 1973 is $5.25 a month. "SECTION 3: Section 12-124 of the Code of the Central Contra Costa Sanitary District is hereby amended to read as follows: "Section 12-124. Minimum rates for special collections. In each Zone, the minimum rate for each special collection requested by a customer is $3.60, except beginning March 1, 1971 for Zone 2 where the mini- mum rate for 1971 is $4.30, for 1972 is $4.90 and for 1973 is $5.25. 04 01 71 1'+ "SECTION 4: This ordinance shall be a general regulation of the District and shall be published once in the Contra Costa Times, a newspaper of general circulation, published and circulated in Central Contra Costa Sanitary District and shall be effective upon expiration of the week of publication. V. BIDS None. VI. OLD BUSINESS SEWER SYSTEM DEFICIENCIES Mr. Horstkotte, General Manager-Chief Engineer, explained that staff memo- randum of March 2 and March 22, 1971, were advisory in nature and indicate what must be done within a reasonable period of time to correct certain system de- ficiencies. VII. NEW BUSINESS AUTHORIZATION TO PROCEED WITH SEWER SYPHON PLANS AND SPECIFICATIONS AND CALL FOR BIDS FOR DISTRICT SEWERING PROJECT 1985 Mr. Horstkotte, General Manager-Chief Engineer, explained that the sewer syphon would be in Bishop Lane and that the costs would be reimbursed by the Contra Costa County Flood Control & Water Conservation District. It was moved by Member Mitchell, seconded by Member Rustigian, that plans and specifications for District Sewering Project 1985 be prepared and the call for bids be authorized; costs to be reimbursed by the Contra Costa County Flood Control & Water Conservation District. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Members: Boneysteele, Rustigian, Mitchell, Allan and Gibbs None None CONSENT TO DEDICATION OF PUBLIC ROADS AGREEMENT, PARCEL MAP M.S. 161-70 It was moved by Member Allan, seconded by Member Boneysteele, that the President and Secretary be authorized to execute the Consent to Dedication of Public Roads, Parcel Map M.S. 161-70. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Members: Boneysteele, Rustigian, Mitchell, Allan and Gibbs None None 04 01 71 /) CONSENT TO JOINT USE OF EXCLUSIVE EASEMENT, LOCAL IMPROVEMENT DISTRICT NO. 52, SCHEDULE 3, PARCEL 4, WITH PACIFIC GAS AND ELECTRIC COMPANY Mr. Horstkotte, General Manager-Chief Engineer, explained that this was a revision of a Consent to Joint Use of Exclusive Easement previously approved February 25, 1971. It was moved by Member Mitchell, seconded by Member Allan, that the President and Secretary be authorized to execute the Consent to Joint Use of Exclusive Ease- ment, Local Improvement District No. 52, Schedule 3, Parcel 4, with Pacific Gas and Electric Company. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Members: Boneysteele, Rustigian, Mitchell, Allan and Gibbs None None MATTERS FROM THE FLOOR CALIFORNIA SANITARY & SANITATION DISTRICTS ASSOCIATION MEETING Members Allan and Boneysteele reported on the meeting of the California Sanitary & Sanitation Districts Association held March 25, 1971,in Sacramento. Member Boneysteele requested reimbursement of his expenses for attending the meeting in the amount of $18.95. It was moved by Member Rustigian, seconded by Member Allan, that reimburse- ment of expenses in the amount of $18.95 be authorized for Member Boneysteele's attendance at the meeting of the California Sanitary & Sanitation Districts Association in Sacramento on March 25, 1971. VIII. REPORTS COMMITTEES PERSONNEL Member Allan reported that Board Members had received copies of the report of the State Cooperative Personnel Services. The Board accepted the report and the staff was directed to release copies of the report to District employees and to invite their comments by April 9, 1971. Continued to the meeting of April 15, 1971, when a State representative will be present. GENERAL MANAGER-CHIEF ENGINEER OUTFALL SEWER REPAIR Mr. Horstkotte, General Manager-Chief Engineer, reported the repair of the Outfall Sewer was completed March 31, 1971, and he expected the cost to be be- tween $20,000.00 and $25,000.00. EMPLOYMENT OF TEMPORARY LABORATORY TECHNICIAN Mr. Horstkotte reported the input at the Pilot Plant had increased from 60% to 70% and requested authorization to engage a temporary Laboratory Technician for vacation relief during the summer months. He stated that it would cost $110.00 per day to employ a Bechtel Corporation technician, whereas he felt he could get someone for $600.00 to $700.00 per month on a temporary basis. It was moved by Member Boneysteele, seconded by Member Allan, that the em- ployment of a Laboratory Technician on a temporary basis during the summer months, at a salary of between $600.00 and $700.00 per month, be authorized. Carried by the following vote: 04 01 71 76 AYES: NOES: ABSENT: Members: Members: Members: Boneysteele, Rustigian, Mitchell, Allan and Gibbs None None DISPOSITION OF ALUM SLUDGE Mr. Horstkotte reported he will be meeting April 2, 1971, with representatives of the Water District and with Brown and Caldwell who will be engaged by the Contra Costa County Water District to make a study regarding the disposition of alum sludge. ABSTRACT FROM TALK Mr. Horstkotte stated he had given each Board Member an abstract from the talk he gave at the California Transportation & Public Works conference in Los Angeles on March 26, 1971. PRE-CERTIFICATION REPORT Mr. Horstkotte stated each Board Member had received a copy of the pre- certification report on the Treatment Plant Expansion prepared by Brown and Caldwell, which he felt was an outstanding job. LEASE OF GRAZING LAND AT TREATMENT PLANT SITE Mr. Horstkotte reported about 60 head of cattle, owned by Jerome Machado, were grazing on Treatment Plant property, and stated he had received a firm offer from another person to lease the property for $240.00 per year and install the fencing needed. The lease would include a 30-day cancellation clause. EUROPEAN AND SOUTH AFRICAN TRIP Mr. Horstkotte reported that he and David Niles, Superintendent of Plant Operations, were leaving April 4, 1971, on their trip to Europe and South Africa to investigate wastewater treatment plants and that scheduled appoint- ments have been made at each location to be visited. COUNSEL FOR THE DISTRICT ORDINANCE 75 Mr. Bohn, Counsel for the District, introduced and read the proposed Or- dinance, and, after discussion, it was moved by Member Allan, seconded by Member Rustigian, that Ordinance 75 be adopted. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Members: Boneysteele, Rustigian, Mitchell, Allan and Gibbs None None "ORDINANCE 75 "AN ORDINANCE AMENDING SUBDIVISION (a) OF SECTION 11-142 OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT CODE RELATING TO EQUALI- ZATION CHARGE FOR CONNECTION MADE THROUGH LOCAL IMPROVEMENT DISTRICT OR SPECIAL ASSESSMENT PROCEEDINGS "BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT, that subdivision (a) of Section 11-142 of the Central Contra Costa Sanitary District Code is hereby amended to read: "(a) When a connection or additional or different use charge is payable, a person intending to use a sewer constructed through local improve- ment district or special assessment proceedings shall pay an equalization charge to the District before the connection or use is made.
