Alm General Manager District Counsel ISSUE A resolution of the Board of Directors (Board) is required to accept offers of dedication of sanitary sewer easements as depicted on subdivision maps and to accept grants of irrevocable offers of dedication of sanitary sewer easements to convey real estate property interest to Central San and to record the December 6, 2018 Regular Board Meeting Agenda Packet- Page 78 of 202 Page 2 of 5 resolution with the Contra Costa County Recorder. BACKGROUND With Job 6568, Developer, Glennmont, LLC, a California limited liability company, constructed public sanitary sewers within sanitary sewer easements. To provide the necessary land rights to the public sanitary sewers, the Developer offered to Central San a sewer easement on a filed subdivision map and also via a recorded grant of irrevocable offer of dedication (easement for sewer purposes). The public sanitary sewers were constructed and accepted per Central San's standards, therefore staff recommends that the Board accepts the sewer easements at this time. Upon acceptance and recording of this resolution, Central San will have the necessary land rights for the reconstruction, maintenance, and operation of these public sanitary sewers. ALTERNATIVES/CONSIDERATIONS The Board could decline to accept the offer of dedication of a sanitary sewer easement. This alternative is not recommended since Central San would not have the land rights necessary to reconstruct, maintain, or operate the public sanitary sewers that have been accepted from the Developer and are now owned by Central San. FINANCIAL IMPACTS The offer of dedication, as depicted on said subdivision map, and the grant of irrevocable offer of dedication of a sanitary sewer easement were acquired at no cost to Central San. COMMITTEE RECOMMENDATION This item was not reviewed by a Board Committee. RECOMMENDED BOARD ACTION Adopt a resolution: (1) accepting the offer of dedication of a sanitary sewer easement as depicted on the subdivision map 9204 from, Developer, Glennmont, LLC, a California limited liability company, as related to the Camino Ramon project, Job 6568, located in Danville; (2) accepting the recorded grant of irrevocable offer of dedication from Developer, as related to the Camino Ramon project, Job 6568; and (3) authorizing staff to record this resolution with the Contra Costa County Recorder. BE IT RESOLVED by the Board of Directors of Central San as follows: THAT Central San hereby accepts the easement offers as stated in said subdivision map, which is more specifically referred to as "Final Map," titled "Subdivision 9204 Camino Ramon," which map was filed on April 23, 2015 in Book 523 of Maps at Pages 21-24 as Document Series 2015-0077467; and THAT Central San hereby also accepts the sanitary sewer easement as stated in said Grant of Irrevocable Offer of Dedication, which is more specifically referred to as "Grant of Irrevocable Offer of Dedication" (Easement for Sanitary Sewer Purposes) for APN 207-140-021-8 ROW Parcel 1 which was recorded on October 30, 2017 as Document Series No. 2017-0204146"; and THAT staff is authorized to record this resolution with the Contra Costa County Recorder.
