Alm General Manager District Counsel ISSUE Section 6490 of the Health and Safety Code of the State of California provides that District ordinances shall be published once in a newspaper of general circulation within the District, and provides that an Order of the Board of Directors of the District to the effect that the ordinance has been published shall constitute conclusive evidence that publication has been properly made. BACKGROUND A summary of District Ordinance No. 300, which was adopted by the Board at its meeting on May 3, 2018, was published in the Contra Costa Times and the San Ramon Valley Times on May 11, 2018. Proofs of publication are attached. The Board is being asked to confirm publication of the summary of District Ordinance No. 300, which ordinance adopted changes to District Code Chapter 2.36.010 and established informal bidding June 7, 2018 Regular Board Meeting Agenda Packet- Page 72 of 446 Page 2 of 4 procedures under Public Contracts Code Sections 22000 through 22045, the UPCCAA. Full implementation of the informal bidding procedures under the UPCCAA is expected to occur by September 1, 2018. ALTERNATIVES/CONSIDERATIONS Confirmation of publication of the summary of Ordinance No. 300 establishes the presumption that the ordinance was correctly published and therefore would be deemed procedurally valid by a court. FINANCIAL IMPACTS None. COMMITTEE RECOMMENDATION This matter was not reviewed by a Board Committee. RECOMMENDED BOARD ACTION Confirm publication of a summary of codified District Ordinance No. 300.
